Just received this as an automated email from njoy. Here is a copy of what I just received a few minutes ago..

*I omitted the ridiculously tacky and convenient advertisement/sale they placed directly above this letter.*

RE: njoy Electronic Cigarettes

Dear Valued njoy Customer,

First, we certainly appreciate your patronage and enthusiasm over the NJOY family of products. We have all been quite pleased with your overwhelming response to this product and recognize you as a very valued customer.

Unfortunately, we must apologize for our current inventory shortages which have resulted in extended delays in your continued purchases of NJOY products. We have recently experienced an interruption in our supply of NJOY Electronic Cigarettes, cartridges and related accessories as a result of the FDA claiming jurisdiction over the product. FDA has detained most shipments of electronic cigarettes and related accessories entering the U.S. for the past several weeks. Their assertion is that nicotine is a drug and the electronic cigarette is a device whose intended use is to deliver that drug. We do not agree with the position or actions of the FDA.

To defend our position of continuing to bring customer like you the first true innovation in a centuries old space, NJOY has enlisted a team of attorneys, scientists, lobbyists, and other experts whose belief is that the FDA has over stepped the bounds of their authority in this detainment action.
We encourage your help to ensure the survival of the e-cigarette as an alternative to traditional tobacco cigarettes that continue to kill 400,000 Americans each and every year. Below is a list of some things you can do to help the cause.
1) Write your Senators and other elected officials. Tell them about your experience with the electronic cigarette. Send it certified mail.
Sample text: "I am a loyal customer of the smoking alternative NJOY, and I have been informed that the FDA has taken the step to bar importation of more products at this time. I want you, as my elected representative/senator in Congress to help me continue to enjoy this product by asking the FDA to remove their detainment order from Customs."
Find out who is your Senator
Find out who is your Congressman
Write President Obama
2) Contact your local newspaper or other media, Tobacco Free Kids, American Lung Association, American Cancer Society and other public health organizations to inform them about your experience with the electronic cigarette.
At this moment, we do not know when shipments are expected to resume. We have supplies of certain replacement cartridges currently available for immediate delivery but those supplies are being rapidly depleted. Once this situation is resolved to our satisfaction, we will enthusiastically support your continued use and support of all the NJOY products and accessories.

We will continue to keep you informed as things develop.

Sincerely,

The third supplier affected was probably InLife.

The future of e-cigs in the U.S. will be decided over the next few weeks. The U.S. Senate is slated to receive the Kennedy tobacco bill (S. 982) next Tuesday. There is no telling how long it will take the Senate to vote on the bill. The language in this bill would essentially provide the FDA with the power to halt e-cig importation, sales and use in the U.S.

Even though this is not a good bill, rather a political ploy to protect votes in any upcoming election, users of personal vaporizers still have time to do two very important things. First, sign the Keep life saving electronic cigarettes available! petition (http://www.thepetitionsite.com/1/keep-life-saving-electronic-cigarettes-available). Tell your friends and family who support your position to also sign this petition. Second, send an email to your Senator and President Obama asking that the government not ban the sale of electronic cigarettes and a few sentances of how the e-cig has improved your life. Hopefully a grassroots effort will effect some change to S. 982. Let it be known that we have members of Congress that use e-cigs.

I believe smoke51, but not 100% positive, so dont quote me on that...It is not just happening to big suppliers, it is happening to a lot of people.
We need your support!!! Tobacco tax goes up on June 1st!!! This is when everything is going down...

please visit the ECA website

Electronic Cigarette Association

We are all in this together!!! and we will all go down together!
E-smoker's must unite now.
Let's make something positive happen!

Agree with you all the way, except wanted to point out that Bill Godshall and others are saying that a hardcopy, mailed letter, or even a fax, is preferable to an email. If we are going to go to the effort of communicating, let's do it in the most effective way possible, IMO.

This is probably the wrong thread for this, but the post reminded me again how sad it makes me that the ALA, ACS... are moving factors behind the ban. I could understand them being hesitant but to jump right in and demand that e-cig get banned is disheartening because I am sure at one point each of these organizations have started out with good intentions. I am certain that these groups would never listen to pleas from the public so wasting resources on them at this time probably isn't prudent, but at some point they should be forced to hear the experiences from some of us so at least a few people there will have to lose some sleep trying to reconcile their mission with the reality. BTW as a resident of the land of enchantment I e-mailed Sen. Bingaman with no response.

This is a VERY good point. What will really get them to reconsider is if someone makes donations to these groups, consider calling them and letting them know they will not get your donation next year if they continue this attack on ecigs.

PS. Thank you for at least trying! You never know. It might have been read and just not responded to... yet.

Thanks ShadowDemon, people sending letters to their senators is what is really needed; and you did it! I'm sure they will unerstand perfectly well what you are saying; and it's good, in my opinion, that your emotions about this device (and the conduct that politicians and FDA are showing on them) is showing; in a polite way too. :)
