This is the most important court case in the history of e-cigarettes, and probably always will be: it is the case that saw the pharmaceutical industry in the USA defeated in their attempt to ban e-cigarettes.

As a result of the fine work carried out by Thompson Hine law in managing a well-presented case in front of Judge Leon, the FDA were forced to abandon classification of electronic cigarettes as a pharmaceutical product, and consider classification as a tobacco product (which requires further legal developments). This meant that instead of the many thousands of products being banned outright and several years passing before one or two could get a license (at immense cost), the FDA had to rethink their strategy. This gives the industry and community vital time in which to strengthen their position.

We can only hope they take advantage of it. The breathing space won't last...
