Lol, I was showing the chief of police in the town I work in my setup last week, he thought it was cool as all get out. If I get pulled over there I'm gonna make them call the chief!

This....

I used to run into the captain for an area sheriff's dept. on a regular basis. I've shown him most of my devices.

Mini's most of the cops have seen, but when it comes to APV's it's a little different.

I am always worried about the police thinking my PV's are something less than legal. Kinda of makes me not want to vape while driving, but the one time I know a statie saw me vaping he just looked at went about his business, that kind of made me feel a little better but still kind of makes me relatively uneasy driving and vaping.

Hey man !.

The most obvious reason, to me, for the law to question someone about their device would be to clarify what the substance they are using in the device is. So if i get stopped and asked i'd say "the substance is nicotine liquid". I really don't think a police officer is interested in the device itself though.

I work 'on call' so sometimes I am out and about at really weird hours. A couple of months ago, I was on my way home from work at 3:30am & there was a sobriety check on the interstate exit ramp with about 10 LEO's, just as many tow trucks and people everywhere touching their noses and walking lines. During my in-vehicle sobriety check, I was questioned extensively about my PV, to the point that a couple more officers walked over to my vehicle because they weren't sure why my officer was taking so long to put me through. Lucky for me, I also always carry my liquid(labeled & with nic dosage), extra batteries and tanks. They asked to see my stuff and then wanted to know how it worked. I was pulled over on the side of the exit ramp for 10 minutes showing analog smoking LEOs a new alternative. LOL

Haha! Today was literally the first day I vaped in my car because I had to drive about 3 hours round trip to see my doctor. I was totally furtive and nervous about it, as if I were doing something wrong ... When meanwhile I'm doing everything RIGHT--finally. It was literally the first time I have used a nicotine product in my car in about 10 years since I also transport children all over creation and have never wanted to endanger them with second-hand smoke or even stinky smells.

I also live in Coloraodo, where we just passed Prop 64, so I was nervous about cops or even other motorists thinking I was doing something "illicit." I guess all of us "early adapters" also bear the onus of having to do a little public education. And I guess I need to educate myself on the best ways to explain the difference between a combustible (danger of second hand smoke) and a PV.

Here's what I know and it's very little being a new vaper myself. My experience comes from the photo world as I do work as a photojournalist (among many other things)

In order for the police to detain (cuff) you they need reasonable suspicion. This basically means that if any reasonable person were to think a crime has been committed or that you are a potential physical threat that could put the officer in danger. Acting like a .... to the cops can elevate suspicion and cause undue stress on the situation. That's why if you explain things in a calm manner they have no reason to be suspicious.

Probable cause is required for them to search or confiscate anything. They do not always (dont quote me but 95% of the time do) need a warrant to search your belongs if there is Reasonable doubt that you did in fact commit a crime. They do need a warrant to seize property that is not in plain sight assuming there is probable cause to do so. They can temporarily "detain" your kit with reasonable suspicion until probable cause is found, but they cannot turn it on, delete photos, or screw with/delete anything. If you only put in legit nic juice your fine. I would only put wacky tobaccy nic juice in at home.

As was explained to me by my lawyer, if you get cuffed but don't get put in the back of the squad car, be cooperative but dont say anything that could potentially make you look guilty for anouther crime, even as a joke. But if you do get put in the back of the car you can request a lawyer even before your rights are read. He seemed very clear about this after I was arrested for "suspicion of terrorist activity" and learning that I know how to get out of handcuffs and zip ties while doing an assignment on a hotdog vendor here in Harrisburg. .

The police don't know all the laws because there so many of them, but they are always willing to learn, especially with regards to new technology. I'm not a lawyer or a cop and this is based on my own personal experiences. If there are any police officers that can weigh in on this, please correct me.

If you get taken in, lawyer up! There is a big difference between being detained, charged and convicted
I like the buisiness card idea. I alread keep them for my autism and photographers rights, so an ecigarette card would be no problem.
 
Welcome to ECF and wow!! I'm sorry that happened, but it does freak me out a little as I just posted the other day on a "vaping in public" thread that I did get nervous using my Ego in the car because I was worried about a cop pulling me over for it. Um...eek.... :ohmy:

YAAAAAY Finally a vapor in my neck of the woods! And yes I agree about being scared to vape near cops! Cuz my set up def looks like that of a druggie lol! Lots of rookie cops round here that don't play nice BUT I'm sure they are up on the technologies! Nice to meet you!
