I am an herbalist. It's a fine line to walk without being fined and/or jailed for "practicing medicine without a license". It might actually be a worse outcome that what we are facing right now.
I know nicotine is used in some pesticides... That is of course at a very high concentration... But I don't know if we can really call it anything else than what it is. The legislation needs to re-categorize vaping as its own entity.
In April there will be a lot of discussions
focused on "work arounds" to the FDA's mischief.
Even Ray Charles (who was blind) could clearly see
the FDA will come after bottle liquids, flavors, and
of course ... since the FDA is owned by BP ... nicotine levels.

I think the problem is that it is created from tobacco plant, thus *may* be regulated as a tobacco product. You could probably get away with a reclassification if you were to derive the nicotine from another viable plant source other than tobacco.
morphine is essentially extracted from a plant too...... is extracted from a plant...i dont think you can get away with just trying to call them herbal products

No, the court ruling did not declare them tobacco products.
Judge Leon just "suggested" to the FDA that they could treat them as such under the FSPTCA.
And obviously, that is what the FDA is getting ready to do.
So not only do I wonder if the nicotine could be treated as an "herbal" product, and what the ramifications of that might be...
I also wonder how having them officially declared as tobacco products could impact the "herbal" angle...
But so far, I'm not sure anyone has an answer for the first question, let alone the second.
Wormwood is also regulated in the United States.....at least the more potent variety. Its a key ingredient in Absinthe.
Theres a magic shop down the street from me that sells magic tricks and has an occult shop in the back with dried herbs.They were raided by the ATF for selling it and their entire stock was seized and presumably destroyed.
