order from states tracking question

hey guys,

So i ordered a package of carts from the u.s that includes nicotine, a supplier i've never had an issue with before getting the product to me.

it has for the first time stated on the tracking canada post site "Customs clearance processing complete" which is the last update on april 18
tht was on thursday of last week, and still nothing in the mail yet.

Should i be worried it may have been seized or should i still be expecting it since it says it has cleared customs?

Regardless of what health Canada would have you think it's 100% legal to import e cig products containing nic in to Canada.

As for your delay in shipping I recently had a juice order take about 22 days to get from the US to my house in BC, I have no idea how long it was in Canada for but it did take a long time to get here.

unfortunately, some people at customs canada does not seem to think the way you do. There are multiple stories here about ppl having their nic seized and confiscated/returned to vendors... Problem is when a person gets into that situation, they are not willing to spend thousands of dollars to fight in court and get there stuff back.. legal or not, it's still pretty much grey!

I'm hoping ill never have to face the situation myself , but there isn't a court case needed. Simply ask them to state which law they are using to hold your product from you. As long as its labeled correctly they have zero grounds to hold it from you. I almost kind of want a juice shipment seized so I can tell them to stuff it and give me my stuff lol. My 50mg PG base for DIY that I shipped here from Ireland was opened by customs and sent along with no issues.

Tooday i got a letter from Health canada saying that they will return my order of 60ml of pluid to the sender which was 310vapers. I'm not sure what kind of testing they do but the order was for 120ML not 60Ml. the order was placed 3/29/13 my tracking says Item has arrived in Canada and was sent for further processing. The letter says the reason for refusal is that the ejuice is an electronic smoking product and "no person other than: a practitioner, a drug manufacturer, a wholesale druggist, a registered pharmacists, or a resident of a foreign country while a visitor in Canada, shall import Schedule F Drug". I order a lot of juice frome the stastes but this was the first time it was a problem. I contacted 310vapers to see what they can do so its not a total loss.

Wow that's super lame. I guess one way to stop you from asking for it etc is to just send it back before they tell you.

CBSA is an enforcement agency with the same powers as the R.C.M.P. or regional police forces. They can hold an item they suspect may contravene any of Canada's laws.

From the CBSA website: The CBSA will hold all controlled goods until it receives the proper permits. When the CBSA receives a mail item that is subject to import controls, it will send a letter to the recipient asking for the permits.

I'm in the process right now of requesting those requests since all I've received at this time is a Health Canada advisory along with the recommendation for refusal letter.

mrjt: My tracking never got to the Customs complete stage and stopped at presented for review.

Marthag: vancouverrefunds AT cbsa-asfc.gc.ca is the Vancouver office. I was told by the main CBSA office they didn't have a telephone number so you had to email them. I'm doing some research before I email them.

I'm going over as much legal information as I can dig up to find whatever might apply and support what's already been written on the subject. ie:
Competition Bureau
Tobacco Act
Trade Descriptions Act (British, but useful for any common law foundation principles)

It's interesting to note that the CBSA website copies the Drug Schedule but edits out a good portion of the Schedule F section to exclude any inhalation device.

I'm a little behind on this since I got my 10% solution. I'm going to inquire with Crown Council as well since they have to approve any charge being filed. I have a suspicion they won't approve any charge as the law is currently written in favour of the consumer.
