Posting news excerpt on a forum is non-infringing fair use

Just figured this would help out a bit and help the forum managers sleep a little easier.

Judge Roger Hunt’s judgment confirms that an online forum is not liable for its users’ posts, even if it was not protected by the safe harbors of the Digital Millennium Copyright Act’s notice and takedown provisions. The decision also clarifies that a common practice on the Internet – excerpting a few sentences and linking to interesting articles elsewhere – is a fair use, not an infringement of copyright.

You must not post material on this Website that you do not own the copyright to, unless it is done so under a Fair Use agreement. Only one paragraph or 300 words may be posted, whichever is the greater, and a link should be given to the original source.

It was just a matter of time before the courts finally got off their collective behinds and made it clear to scumbags like [name redacted] that the principle fair use is universally applicable and covers electronic media.

Now if they would only realize that in the new world order forums deserve safe harbor as much as ISPs do.

It was just a matter of time before the courts finally got off their collective behinds and made it clear to scumbags like [name redacted] that the principle fair use is universally applicable and covers electronic media.

Now if they would only realize that in the new world order forums deserve safe harbor as much as ISPs do.


LMAO, you know I totally forgot about that situation. But I figured you guys knew about the fair use provisions, just figured you'd like to know you had some backup as well.
