Thank you for your email. As you know, we have been in the process of challenging Health Canada on several fronts. We opposed Bill C-36 because of its unconstitutional removal of the rule of law and we are now working flat out to produce a legal case against the NHP Regulations, our aim is to have them suspended before the reintroduction of Bill C-51 after the election.
As we take Health Canada to court we sincerely hope that their unsupervised powers to control and ban items in areas other than the natural health community will naturally follow, however we have no specific expertise in the area of electronic cigarettes. It does look as though the medical devices industry is one of the next in their sights and we hear that this is the justification they are using to restrict access to the products you need.
We are challenging the NHP Regulations in court right now, since this is our area of knowledge and the community which supports us financially. Many similar principles will be tested however and we hope that our challenge will shine a light on the behaviour of Health Canada in all other areas of operation.
We are running a national fundraising drive to collect the dollars we need not only for our daily operations but to file a lawsuit against Health Canada. In order do to this we need to finance an expert legal team big enough, and for long enough, to take the case to the supreme court. Shawn Buckley has been interviewing firms and lawyers who he feels can do the job, and guided by him, we are preparing our team of experts. The Department of Justice has unlimited funds and resources. We only have our supporters.
