To me it's simply the issue of not warrantying for 24 hours for DOA...and the law that says goods must be fit for purpose...buying a MP and having any DOAs make them not fit for purpose and being willing to exchange them and go on record saying that policy would be to exchange them and I'd have been done with the issue..

I agree with you. 24 hour warranty against DOA would be excellent.

I'm not an attorney, and I do not know what the legalities of selling DOA items might be, but I have bought plenty of things in my life without a hint of warranty. It's a calculated risk. Find a screaming deal on ebay with no returns are accepted? Buy it OR DON'T. You're risking your cash.

Have an item to sell that you cannot say for sure if and for how long it will work? Sell it and hope for the best OR DON'T. You're risking your business.

Aren't we all making our own decisions?

That was the thing and what I posted...they're a UK company just trading in the US so they should be bound by UK restrictions...and the UK laws for distance selling of goods state that goods must be "fit for porpose" (they do what they're supposed to do) or else they should be repaired replaced or refunded....so not replacing or warrantying DOAs in a multipack is pretty much contrary to those regulations.

After reading the thread, it sounds to me like he had made the decision long before this to sell the us company. He is just tired of running it and this just pushed him to make the decision now. This too is probably why the poor customer service, he was tired of dealing with the us branch at all and probably ignoring it to a great extent.

Hey, I got a free bottle of juice for my comments and they weren't nice either,lol If it arrives in good condition I will post that it did. If it doesn't I will also post that it didn't.

I've asked many times, why would you not put a warranty on DOA goods unless you knew you were sending something that didn't work? I have never gotten an answer for that one.

I have went back and forth on buying from them ever since I started vaping a year ago. I have always seen so many complaints and not a lot of resolution and that scares me. I know it doesn't seem like it on here, but I really do have a very limited income and I have to plan and watch how I spend my ecig budget so I can't afford to throw it away. I've sent the email to get the free bottle but I will have to see a lot of changes before I order from them.

I've actually never ordered from them, their website put me off to begin with and all the bad reviews did not help.

I ordered once last yr from TW, It was not a bad experience for me . I just thought they were over priced and the juice wasn't so great that I saw the need to pay extra for it.

I bought my original Tornado from TW and when the atty went out 2 weeks later I emailed for instructions on returning it under warranty. It wasn't easy finding the right email address for returns but within a couple of days I received an address to mail in the atty... different from any addys on their site. Within a couple of weeks I received a new atty. So, I can't say I have ever had any problems and in fact was happy with the service. What I do have a issue with is seeing others have problems and how TW ignores them. Just because I was taken care of doesn't mean I don't have a problem ordering from them. I only ordered once because of the lack of respect they have shown OTHERS. Not replacing DOAs is wrong and he was given plenty of opportunities to fix the policy before now, but he didn't. Then when he bashed UntamedRose I lost it! Don't ever say anything bad about my sister!!! LOL I agree, he's burned out and has an attitude about Americans.

49 of the 50 states (I think LA is the one without) have laws of implied merchantability. In real simple terms if you sell something saying its a 'xxx' its really got to be a 'xxx.' All the wonderful wording in little letters on receipts or signs by the register or door don't mean a thing. So all that all sales final can be ignored. Granted, it can die/break/collapse/etc. seconds after you've received it but its got to be good initially. You can sell things with no warranty or call it whatever you want but its still got to be good initially.

The only 'way around' these laws are to add the condition to the description, for example "TV for hobbyist, may not work." In that case the TV you sell doesn't have to work *but* its got to be part of the item description. Taking that same hobbyist TV and putting it in its box on the sales floor and then selling it with wording on the receipt that say "for hobbyist may not work" wouldn't be legal. That's because a normal person would reasonably expect a TV they see at a store to work so you've got to explicitly inform the customer of its possible non-working state. All it takes to make it good would be to stick a sign on the TV saying 'may not work.' Very simple law actually.

This is basic consumer goods law. Anyone with a sales business should know these.
