Driving into work through crazy traffic on a motorcycle is dangerous, should we ban that too?
Eating cheeseburgers everyday is bad for your health, can we not hire based on that?

I could go on forever, you get the idea.

I regardless of being a smoker or not would not work at or support any company (if i could help it) that blatantly discriminates and tramples on peoples liberties.

I'm sick of this "Nanny State" attitude. Just sick of it.

Employer: Can i see your last months debit transactions?
Interviewee: Sure, but i don't see what that has to do with selling shoes?
Employer: I see you have purchased from McDonalds 3 times in the span of a week. We are not able to take in your application at this time, as it would raise the healthcare premiums that we offer.

slam dunk law suit, and they provide the evidence, don't even need a lawyer to grab a few K from these guys.
just apply, and when refused file the suit. they leave themselves wide open for it.
there are 100s of personal habits that affect productivity,
I know a guy that takes a full hour just to make his morning coffee. nice guy, but wth, whatever.. none of my business.

We are nicotine users not smokers. For them to discriminate against us they would also have to discriminate against Nicorette and patch users as well as whatever other Nicotine delivery devices they have.

Thats just the thing they will be discriminating against anything with Nicotine... The companies in the states are doing tests to determine if you are a smoker by testing you for nicotine.

In my informal observation there are far more obese employees than smokers but they would never ban the junk food vending machines or deep fried food from the cafeteria BC there would be a far louder out cry.

All schools in my region have already banned the junk food vending machines AND deep fried food from the cafeteria.
