So what if E-Cigs are banned?

I have been analog free now for 5 days, using the e-cig for 10, AND I DON'T WANT TO GO BACK!.

So..., what if the FDA gets what they want and these things are officially "banned"? Will a black market pop up so I can continue on? I really do not care about technically being a criminal, saving my life is more important. I would really hope there would be suppliers underground out there. Just how much enforcement do you think would be applied if they do get banned? I must say, I am seriously worried.

Obviously, none of us really knows, but if you just wanted some opinions here is mine...

I think there is about a 35% chance the FDA will win the current court case and have them declared to be drug devices. If that happens, they will essentially be pulled off the market for quite some time. Then those that have the money to get them tested will eventually get them approved, and they will probably be available by prescription only at first. The nicotine strengths will be strictly controlled, and quite possibly reduced to the point that they will not work for many people. The cost will be much higher than it is now, and they will probably only allow disposable cartridges which they will try to make as tamper-proof as humanly possible.

I think there is about a 65% chance the FDA will lose the current court case and then they will shift towards regulating them as tobacco products. They will probably decide that we can only have tobacco flavors, although I have no idea how they will determine what is and what is not a tobacco flavor, but we will almost certainly need to fight them very hard if we hope to keep our flavors. But even if we fail, we will still be able to buy our own flavorings and add them if we want to. The bigger worry is that they will probably limit the nicotine strength to something they consider recreational, which won't be enough for many of us.

But the good news is that if you don't mind ordering from outside the United States, you should have no problem getting whatever you need in small packages. The bad news is that all of the wonderful juices made by the folks in these forums will be gone, and all of the suppliers will be out of business.

As far as a black market developing, I just don't see that happening. I don't think there is enough money to be made to justify the risk, especially when we can all still order things from outside the United States with much less risk involved.
