So, there is no law against e cigarettes containing nicotine in Canada but there is a ban against importing them. I am confused!
I am travelling back to Canada next week and I am taking back a couple of cases of njoy Kings with me. I am NOT going to take anything else just in case there is a problem. Since they are not regulated I shouldn't have to declare them as tobacco. If I am questioned then do I say that there currently is no law preventing me from bringing these in because they meet the requirement of being less than 4mg per dose? 1 njoy at 4.5% = 2 packs (40 cigs) therefore 1 cig (1 dose) should be .001% or .1 mg. Is this right? Since there is no regulation then, I should be able to bring my entire personal exception of $800.00 in NJOY.

If customs gives you a hard time, just state what you know to be fact:

1. There is NO ban on ecigs or the liquid nicotine...there is an advisory warning ONLY (and you can tell them that you are well advised, lol).

2. Personal vaporizers are exempt from Health Canada regulations as they are not a medical or drug delivery device

3. Nicotine is exempt from Schedule F classification of the Food and Drug Act (as in it's legal, you don't need a prescription etc) specifically, as follows (bold emphasis on (d)):


Nicotine and its salts, for human use, except

(a) in natural substances;

(b) in the form of a chewing gum containing 4 mg or less of nicotine per dosage unit;

(c) in the form of a transdermal patch with a delivery rate of 22 mg or less of nicotine per day;

(d) in a form to be administered orally by means of an inhalation device delivering 4 mg or less of nicotine per dosage unit; or

(e) in the form of a lozenge containing 4 mg or less of nicotine per dosage unit

wanna bring me back a couple njoy kings? :) ive always wanted to try them but havent got a chance to go down to the states and pick them up

I've heard thise NJOY Kings are good, but $800 worth! Are these for your personal use or just to try and convert smokers?

Ha! I don't know about $800.00 worth but that is my personal exception so technically if I wanted to and since these have not been regulated as tobacco products, they would not fall into the 1 carton minimum. Similarly, the independent study commissioned by NJOY and used to win their lawsuit against the FDA shoes that the mg of nicotine per dose (100 cc/ml) is actually less than Nicotrol inhalers. I've attached the report in case anyone is interested.

Having said that, IMO, NJOY King is the best disposable e cig on the market however it is expensive and battery life (again) is not what it claims to be. 1 NJOY realistically lasts me one day and I was not a heavy smoker. So they have their place in my drawer of vaping options to use in restaurants or at the airport or anywhere that use of my eGo PV would not be acceptable.

.....and to your point of converting smokers, when I purchased my haul at 7 eleven, the clerk and a patron asked me about them so in the spirit of pass it on and you can't keep what you don't give away, I opened two packs, let them try it (both liked AND ARE over 21 AND CURRENT SMOKERS) and keep it!

P.S....just skyped my hubby and he said there was a piece done on Global TV last night on vaping, I am going to check it out and post if no one has.

Yes as as the video mentions - Show me the Law - According to their own laws, it is exempt. Hopefully if enough people start saying the same thing to CBSA and HC, the message will be clear. If you can show me a LAW where I am breaking the LAW, then okay, but according to your own LAW we are clearly exempt. AND there is NO ban, only an advisory put out by health Canada in 2009. :)

It's puzzling. There is no law against, if it's considered a consumer product. Why has the media been reporting that there is a ban since 2009. Why hasn't HC stepped up to clarify this point. To be honest, I thought the venders were skirting around the law somehow. So much disinformation. So much Spin. We've been had by the experts of spin and disinformation (government, tobacco, big pharma and the media). Their stories should come with a disclaimer stating that this lie has been brought to you by............! The deeper I dive into this whole battle over e-gigs the clearer things become. Everything that has a value whatsoever is corrupt. You can't trust the elected officials, corporations or the media. They all lie.

I expect the anti-smoking groups to lie, and they never let me down in that regard. They want to ban the flavors that we enjoy, they only want us to have tobacco flavor and they want us to be outside with the smokers. Lets face it, they want us to smoke tobacco. And I'm sure next week they will be announcing that second hand vaper cause birth defects in emperor penguins complete with a photo of a dead baby penguin lying on the ice. Maybe we should put out a warning of our own, if you become an anti-smoking zealot and crusade against electronic cigarettes, this will lead to compulsive lying to the point that you believe your own lies.

We have to stand up for ourselves. I'm an adult. I like flavors. I choose to use an e-cig over tobacco. I am not doing anything wrong, so please stop telling me I am. Like the lady said in the video, "show me the law". Hey that's a good chant.....SHOW ME THE LAW.....SHOW ME THE LAW......SHOW ME THE LAW.....etc. You can do it. SHOW ME THE LAW....SHOW ME THE LAW.....etc.

The reason why HC hasn't stepped up is because they created all of this out of fear. It is in their better interest to keep up the spin. It is clear to me that the FDA clearly convieniently omitted key criteria from their study that they threatened NJOY and others with. They spun it in such a way that it is immediately associated with something bad. The more that lie is repeated, the more people start believing it and repeating it

Good for you! This reminds me of when I lived in England - analog cigs were expensive, but you could buy them much cheaper in other EU countries and (due to the free movement laws) there was no limit in law on how much you could bring back.

I would fly to Spain every few months with an empty suitcase, fill it with cigs and fly home the same day. Customs would always try to make an issue out of it, even though they had no legal justification for doing so.

It got to the point where the exchange would go "Got any tobacco?" "Yep, 20,000 Silk Cut and there's Eff All you can do about it.":laugh:

Incidentally, if anybody up there needs any supplies mailing to them, I'll be happy to trade for Smoky Bacon or Roast Chicken flavor potato chips...
