To their slight credit, this prohibitionist outfit masquerading as a legal group at least put (Optional) next to the e-cigarette definition.

And as we all know, such a contract provision would be completely unenforceable absent someone (perhaps in violation of privacy laws) taking photos of a person using their e-cigarette through an open window.

I'm very disappointed that Doug Blanke, who created and heads the tobacco Control Legal Consortium in St. Paul, would falsely claim (or would allow his staff to falsely claim) that e-cigarettes emit smoke in a deceitful attempt to ban their usage indoors.

I used to respect Doug's honesty and truthfulness when he was an assistant Attorney General under then Minnesota AG Hubert H Humphrey III, who was the only State AG that successfully litigated a trial in court against cigarette companies back in 1997, which prompted the cigarette companies to settle with 46 other State AGs.

The tobacco Control Legal Consortium used to do good work to protect people from involuntary exposures to tobacco smoke, but during the past several years TCLC has changed its goals to advocate tobacco/nicotine prohbition policies and laws.

Karen Blumenfeld of GASP is also a member of the Tobacco Control Legal Consortium, which includes folks from about five different law schools.

The Tobacco Control Legal Consortium's materials on e-cigarette regulation is far more extensive than just landlord/tenant contracts, as they also developed (back in May) a document entitled Regulating E-Cigarettes at

This document promotes (but claims it doesn't) state/local regulations to ban/restrict e-cigarette sales and usage, misrepresents scientific evidence and health risks/benefits of products, and refers to FDA's attempt to ban e-cigs as regulation.

While the document also properly cites laws banning e-cigarette sales to minors, it repeats false accusations that e-cigarettes are target marketed to youth.
