vaping in a pub/bar

Is it legal to get tossed out from vaping in a pub/bar ?
It seems like it would be illegal because the their reason is saying you are smoking a cigarette but your not though.

I mean i know they have a right to refuse service to anyone but i think they would have to have a valid reason though.

Seems like theyd have to have "no vaping" rule. but to throw you out for "smoking a tobacco product" or whatever would technically be illegal wouldn't it?

This is a “touchy” and controversy subject.
It is the same as asking you if I can smoke at your home. You can allow it or not. Same with a private (all) bars and pubs.

You only need one person to complain or a hard headed waiter/waitress/manager/owner and that’s all.

I vape in my regular bar. I started in “stealth mode” but in the heat of the moment, sooner or later you end up showing it… so my approach was “friendly” with people, checking if nobody was bothered and then I talked to the owner. He didn’t know about e-cigs; I explained the best I could and show him the odorless vapor. His answer was simply “perfect” to my taste. He was impressed and told me to go ahead and do it but if he started receiving complains of other patrons, he would need to ask me to stop.

Since that day, my strategy is simple; I do it cautiously and I switched from a white PV to different colors and a tick… nothing that can look like a cigarette. Many people are curious, some ask questions some simply tell me “you can’t smoke here”, when I face one of those, I simply smile and lie: “I’m sorry, does this bother you? It’s not a cigarette, It’s a personal vaporizer to help me breath and have my throat clean “… not one have told me to stop. I, of course, do not puff great ball of vapor.

So far, so god.

hmm well this angry bouncer guy threw me out saying i was lighting it with a lighter.. then a couple weeks later when everyone (but him I guess) got clued in on what it was they said no problem.. and then he came up to me and said he was gonna throw me out if i didnt put it away. no one has complained. he just has his own personal issues about it. but it got me thinking. canhe legally throw me out for "smoking" when i am not technically doing that. his reason is BS. seems like hed have to just say he doesnt like me or has to come up with some other reason because im not smoking.

These types of establishments reserve the right to refuse service to anyone, for any reason. I vape in non-smoking bars, and am usually very popular because when the weather is bad smokers flock to me with questions. If I got tossed from a place for vaping I would just go somewhere else. If they don't want my business plenty of other places do. I haven't had a problem at all.

In a situation such as this I would have the bartender explain it to him. Perhaps he is slow to the draw?

Just know that if you choose to vape in a bar where smoking is banned, expect to be hassled by someone sooner or later. I will generally follow the rules that are used for smoking and go outside, it's what I'm used to already anyway. Caring and Kind and Considerate lol

I agree. I would love to just whip out my 510 and go to town whenever/wherever but that's just not the way the world works right now. I can't bring myself to force others to tolerate what I think is right anymore than I would like them to do the same to me. Vapers and non-vapers have to get along or we'll be buying our stuff black market sooner than we think. We vapers can't just go around and be obnoxious or defiant just because we feel that it's not fair. We are all ambassadors for the vaping community every time we use our PV's in public. If the owner AND the customers are cool with it....great. If either one is not then I will put it away or go outside. Remember....every person we might anger by acting in defiance is one more "anti" in the "anti" army. For every one person who voices their anger to you, you can bet there are at least 10 more who feel the same way and just didn't get to you first.

Agreed. Better to use your judgement. Why make others hate us vapers? That can only make our image look worse (as if smoking cigarettes is any better)!

Right, we should not force our way; but we cannot be silent and avoid spreading the word or trouble and just blend with smokers. In that moment, we are recognizing we are doing the same and our devices are as harmful and stinky as smoking.

Again, I’m not saying “just do it”’ but I’m an advocate to courteously talk, ask, explain and try.

When I started vaping, I did it as a smoker; in my local bar I was in the street. Later I stealth and it was when one waitress who used to smoke saw it. She was impressed and then talked to the manager. The manager just quit smoking because she just had a baby, se impressed too and that’s the moment I asked. She told me it was fine. Despite this, I went ahead and talk to the owner and showed him the device, explained and got another yes.

Is it a hassle? Sometimes, you have to be nice and explain and answer a million questions but it worth it. I all honesty, even if I get annoyed I keep on smiling and talk and answer all the questions; I was an smoker too, a heave one and I would had appreciated if someone had showed me this years ago.

As “ambassadors” we should spread the word not be just one more in the crowd.

More smokers take notice of you when you vape inside the bar, they get enticed for it and encouraged, at least to check it out while if they see it outside, where they are relegated, most don’t even mind because they see it is “as bad as smoking”.

I think that my plan is to just follow the same rules that smokers have to follow in my state. If you can't smoke in a bar, I won't vape in it just out of courtesy. It's not worth the trouble for me. I'm used to it since I was smoker. I know where I can and can't do it without hassle.

ya same here otherwise you look like a tool

I can vape in my favorite bar now but couldn't a year ago. The owner actually had no problem with it but asked me to do it outside just to avoid conflict with customers. I see where he is coming from. As an owner you want to make your customers happy. Also, people do crazy things when they are intoxicated. last week a guy that was all buzzed up lit up a cig because he thought I was smoking and thought it was ok. Needless to say he was bombarded by people forcing him to put it out. Meanwhile, I kept puffing away. I'm the weird guy that vapes at the bar. As far as I know I'm the only one.

I vaped last weekend at a bar, though as discreetly as I possibly could. Nobody seemed to notice much, however the bartender at one point asked me, "are you smoking?" I said no, it's an electronic cigarette. He then said "oh, cool" and left me alone. But if I were told to refrain from using it, I would certainly respect any establishment's wishes.

I'm a noob, one week vaping... so I tried it in a local restaurant/bar here for the first time (one that doesn't allow smoking).

I didn't know the bartender when I first walked in, so I kinda "stealth vaped" at first... it's a place near me, where I usually stop for a drink or 3 before heading across the parking lot to the Mega-Multi-Google-plex theater. Shifts changed, and a bartender I've known for a while came on...

We shook hands, said the usual "hi's"... and I asked him, "hey, you mind if I vape?". He didn't bat an eylid. "Yeah, man, that's cool... someone else was in here last week with one of those." (gotta find this person, lol. BTW, if you're in West Monroe, Louisiana, it's the El Chico by I-20).

So I showed him the parts, how it worked, etc. He asked about the flavors, like "can it be any flavor of tobacco you want?" I said, "It can be just about any FLAVOR you want... cherry, bourbon, chocolate, tobacco, hell even 'Kung Pao Chicken' and 'Roast Beef'. There's no rule that says it HAS to taste like tobacco at all! Wanna try my black licorice?" He said he didn't smoke, but his mom did, and he's thinking of getting her to try one just for health reasons. Told him about the many, many pro's and very few con's of vaping, Very cool conversation. I openly vaped without any hassle after that, and even got a few nice questions from other patrons. Very positive experience for my first time openly vaping in a "non-smoking" area.

I guess it's just a matter of not being a jerk about it.... talk to ppl, they'll be receptive generally. Or be super, super discreet. [at first, the owner was staring, I swear STARING at me... but since I held it in until the vape wasn't visible when I exhaled, and palmed my DS-103 so the LED was hidden and you couldn't really tell what I had in my hand, even he didn't say anything].
