heres the main problem....drunk ppl dont know what vape is and will think if you can smoke i will too.

and also there is a huge fine for the bar if they are caught. they wont risk it with you. even if it isnt smoke(so states have classified vaping as smoking)

o and also....they can theoretically kick you out for anything they see fit

a bar can't toss you out for the color of your skin but they can for just about any other reason. I had a friend get tossed out of a bar for wearing the wrong shirt once. It was a sports bar and he had a t-shirt on that was from the opposing team. He tried making a big deal about it but he got nowhere. If you're asked not to vape please don't. However, you could consider going over his head and having his boss tell him to knock it off.

Being a manager of a Non-Smoking establishment, for one I can say that the bouncer/business does have the right to ask you to leave their premises for any reason. Smoking/Vaping is all the same in the eyes of a crowded entertainment business. I've posted this story before but will say again:

Before I knew anything about e-cigs a customer was using one in my establishment (bowling alley). Another customer complained about it so I went down and kindly asked the person to step outside and smoke. He explained what it was, however it does look like you're smoking, and having to explain to 20 other customers that were around him at the time, just wasn't worth it. I still asked him to step outside, which he did.

In my business, as well as any other business, even if someone doesn't complain, they can still be upset and leave without saying anything and never return. Then they leave and tell all of their friends that my business turns a blind eye to smoking. Since they were non-smokers, I have to assume their friends are non-smokers so I'll also lose their business. It's a trickle down effect that could be very costly for me. The same with any other business.

I vape now, but still do not allow it in my establishment for that reason. I do it behind closed doors, and allow my employees to do it out of sight from customers..

Personally I can not fault a non-smoking establishment to also not allow vaping...

You do need to remember that there are so many people that do not know what a PV is and if they see the "smoke" they are going to either ask questions if it does not look like an analog or they are simply going to be against it. There are a lot of antis to smoking and I think it is ridiculous to think that PVs are going to become the norm. If it does happen it will not be for a long time. These are new and there is a lot of contriversy around them. If the FDA regulates them as a tobacco product then I think we will be okay, but they are pushing them as a drug delivery device and until they are proven to be safe there will be this type of critisism.

On another note, I was in a bar downtown in denver and asked if I could use the e-cig there. The bartender told me that as long as I am not bothering anyone and there is no smell that she did not mind. No one said a thing to me or to the bartender while I was there. I think that because it is an Envy and they are black that no one thought it was a cigarette. I asked another bartender at a different bar that same day and they told me that I could not do it there. It really depends on their views of it as to whether or not they are going to let you.

I post this because a lot of bars and restaurants could use e-cigs as a way to reclaim some of the business they've lost to smoking bans. Talking to bar owners, showing them how it works, and helping them implement vape-friendly protocols could be valuable to us.

I think it's sort of pointless to make this point to the front-line people (bartenders and bouncers). Go to management, and explain how use of PVs could be beneficial to them.

These guys could be HUGE allies when it comes to fighting bans. It's just important that we approach it the right way!!
