Wal mart won't lease me space for b&m store...

My guess is that its in the lease in some shape or form and likely there is verbage in an existing tenant's lease under their user clause.

One such example is if I decide to open a chinese restaurant on the property I can negotiate the lease with the landlord (in this case WalMart) that no other tenant can sell chinese food. Or if I'm a beverage store owner, my lease would include a section that states no other store is allowed to sell soda, have vending machines or serve alcoholic beverages.

Same applies for a High End store selling $1,000.00 dresses..............they probably negotiate the lease to ensure a dollar store or Mc Donalds's can't lease space near them as those stores don't represent the target customer the are trying to attract.

Basically what I'm trying to say is other tenants may already have a say in what businesses are permitted.

Yeah, I looked through several "handbooks" for anything like that. As near as I can tell, I could sell ACTUAL cigarettes, which Wal Mart certainly sells. Very strange!

My Wal Mart does not allow in store use and will not sell them until there are specific state and federal laws regarding age, type of product it is, taxes and if it should be sold open or something you ask for from the pharmacy or the cigarette aisle. As far as they are concerned, it is not legal nor illegal, it's borderline and unless it is solidly legal and regulated, it does not go in the store.
