That statement is correct at this time.

Yes, and when they get "deemed" to be a tobacco product THEN the FDA will be able to regulate them as such.
What I am asking is what the extent of FDA authority really is. Apparently in 2009 the FDA tried to ban import of every sort and kind of vaping product and the courts shut them down. Now they are holed up in their ivory tower letting the public and public health authorities rip each other apart and contemplating--what?
They are contemplating what the final "deeming" regulations are going to say.
And we are contemplating how, and how much, those regulations will change the vaping industry.
Then there are the States. New York Governor Cuomo threatens he will ban the sale of flavored eliquids. Is he serious or just jockying for position?
Good question.
If he can do that it might shut down all the vape shops which is bad if you own a vape shop or need them for quit smoking support but does State government have the authority to criminalize vaping without doing the same to tobacco? How much authority do they really have?
They can pass all kinds of various restrictions.
