Eastern Wa.

Thank You for posting this.
I live in Eastern Washington, and could not attend. It sounds like it went well (for us)
I'm also sure now, after watching this, that the persons voting on this bill don't have a clue !
I guess it all boils down to ... them caring more about the $$$ than our health.
I hope they do some research, but I suppose that's asking too much ..that would be a 1st.

Update on WA State House Bill 2795: A substitute bill was adopted by the House Finance Committee this morning much to the dismay of many WA State Vapers and Vendors. The full text of the amended bill can be found here: https://app.leg.wa.gov/CMD/Handler....umentcontent&documentId=peuLVSdd3A4&att=false

The next step for legislators is to take the bill to a vote on the House Floor, and there will likely be additional public hearings on the issue before that happens. There are many legislators that are on our side, and it is imperative that we make our voice heard as loud as we can. There is a rally scheduled for 12 noon on Saturday March 8th on the North Steps of the capitol building. I strongly urge anyone who can attend to be there and show support. There is a facebook event with more details here: https://www.facebook.com/events/424577141011198/

Haven't gone through the whole thing line by line, but if this is the only change:
Proposed Substitute House Bill 2795
By Representative Carlyle
EFFECT:
Excludes electronic cigarettes that are prescribed by a licensed physician and purchased at a pharmacy
from the definition of "tobacco product" at such time the United State food and drug administration
approves electronic cigarettes for tobacco cessation and other therapeutic or medical purposes. Identifies
the other tobacco products tax rate on electronic cigarettes is seventy-five percent of the taxable sales price

it isn't really much better. And the patch is not a prescription any more - bet the won't be taxing that at the new rate. Big Pharma won't allow that!

Thanks for the heads up.

In addition to that it re-defines the tax on "tobacco substitutes" from 95% to 75%. Not much better at all. The vote was 7-6 in favor, and I know there are some legislators that feel very strongly against this bill. We have a fighting chance and I hope we can all band together and get our message across.

WOW, never thought of that ... what a joke ...should be interesting.
Did you see what MtBaker had to say at the hearing ??
They came right out ..told them that they already charged Wa residents the sales tax, and if this was implemented,
they would leave the state.
Also told them they had plans of opening up a place in Lynden, and it was now on hold until they saw what was going down.
I'm about ready to leave too.
Hubby says .."just tell me when to start packing"
We'll see what happens .. I'm old enough that I won't be around another 10-15 years, and I'll tell then to shove it before they ruin the amount of time I have left.
I earned a right to enjoy it.
The only catch is, it's spreading from state to state, and where will it be OK
Then there's the glorious FDA. Looks like I'll be stuck sitting it out for a while.

MBV sent me a list of all our corrupted politicians in our state as I'm sure its the same e-mail all of you got. I copied and pasted all of their info in a new e-mail that I wrote out. I sent all those .......s the longest letter I have sent in a long time. It had to be atleast 1000 word if not more. Some of them sent me something back but most of them didn't.......LAZY!!:grr: and good for nothing but taking our money. I didn't call any of them and I'm sure I would have only got VM anyway. I hear now they are lowering to a 75% tax oh boy isn't that a whole lot better. Anyway I could go on for along time about this but just wanted to say Hey to all our WA vapes out there!!:rickroll::vapor:

Early word is the WA bill is dead.
Why ... according to an Eatonville friend ...
Among other things, a rather large groundswell of communications to them, Provari on TV talking about putting planned expansion of their budding tech industry on hold, MBV saying they'd leave the State... Many local vape shops closing - and needing unemployment.

And, of course, elections are coming.

But word is the proposals didn't get into the budget bill.

This time.

Former Washington resident (21 years out of 39) currently living in Oregon. I really want to move back to my mossy roots, so hopefully this legislation will end up where the proposed new taxes on loose tobacco a few years ago did. Bad part it is took a judge to knock that one down.

Good luck, WA. As the legislature is proving with the medical (illegal in other states substance) issues, they just are not thinking right.

White House OMB rejects FDA's draft regs for e-cigs as too restrictive, tells agency

This was posted by Bill Godshall elsewhere.

"Several reliable sources in DC have confirmed that the White House Office of Management and Budget (OMB) has rejected the draft e-cig regulations FDA submitted to the agency back in October because they were too restrictive (just as I've been saying since 2011).

While there haven't been any news stories exposing this huge victory for vapers and the e-cig industry (and the White House OMB isn't likely to acknowledge this to any news reporter, as doing so would reveal a split within the Obama Administration), this would explain why the FDA deeming and other e-cig regulation still haven't been proposed (i.e. published in the Federal Register) despite past assertions that the e-cig regs would be proposed in October, then in December, and then again in January.

A news story several days ago exposed our campaign urging the White House OMB reject the FDA's e-cig regs
(including meetings with 35 different companies/organizations/groups) is at
E-cig industry on tenterhooks ahead of U.S. regulation | Reuters

I suspect it would take the FDA another several-to-six-months (and perhaps longer) to draft and submit another e-cig regulatory proposal, which buys us some very important additional time to expose the facts about e-cigs, expose and criticize the false and misleading claims by e-cig prohibitionists, and further expose and oppose the lethal (for vapers and smokers) ramifications of Chapter IX tobacco regulations if/when they are applied to e-cigs.

Don't know how many different sets of regs the FDA has drafted for e-cigs since 2011, but they've missed a half dozen dates they previously claimed the e-cig regs would be proposed (the first was in October, 2011).

So while this is a huge temporary victory for vapers and the e-cig industry, we must now step up our efforts to defeat the next FDA e-cig regulatory proposal before the agency mobilizes another PR and lobbying campaign (as occurred from Sept-December) for its next e-cig regulatory proposal.

If you haven't already done so, please contact your members of Congress urging them to oppose FDA e-cig ban/reg per my alert at
Action Alert: Urge Congress to prevent FDA from banning e-cigarettes again and to stop FDA from giving the e-cig industry to Big Tobacco

This setback for FDA also should help us focus our efforts on defeating the many awful state/local bills we now face (as 49 State legislatures are currently in session, and many will end their legislative sessions in March, April and May).

Thanks to everyone who met with the White House OMB."
