AiV needs to get a lawyer involved, no kidding...

It is EXTREMELY costly to fight something like this and it can take years. Copyright infringement, use of a variant of a registered name, all one has to do is change a letter or 2, change the lines of a design and you play hell trying to gain anything in court. My dad went through this with his business, PITA. His only benefit was endless funds.........it's pretty pathetic "Charlie" would stoop to this level to promote his business. JMO.

i feel the same way and will refuse any offer of a coupon for doing this. They do so much for others just to put smiles on their faces, and do not deserve such unethical behavior from others.

Put on my Business 101 hat, hope it didn't come off as threatening, but honestly, I believe it was far from a mistake on their part, and the difference between New Mexico and Texas can be easily missed by future customers of either company, the "it's down South" mindset.

As far as the vape community supporting each other, WHY in heaven's name would they create something that would only cause a division in the vaping community? If they really wanted to use an Alice theme, there are so many other choices they could have used.

Sometimes that CAN work. Sometimes.

I can see how this might effect sales of AiV at B & M's and online through Giant. And if AnV has sub par juice, it could also effect AiV sales just because of the close nature of the name........grrrr........what a cluster ****. My thoughts go out to all the folks at AiV, it's a real tough situation to deal with.

A store in El Paso, TX recently launched with a very similar name to us. A Vapelandian brought it to our attention a couple of weeks ago and we called the store. We explained to them that Vapeland is a very unique place that has been cultivated so carefully by the love and care of so many Vapelandians. We said that we completely understand that they also share a love of all things Alice, but we would greatly appreciate it if they could form an identity that is just a little more different so not to cause confusion . . . Alas, Charlie, the owner, told us that he never would have created such a similar name . . he had done a thorough google search and didn't know about Vapeland. And, unfortunately, he said he had already made his labels and business cards and would not change the name. We sent him a letter again asking him to change the name but have not heard a response. It is a sad thing because there is so much fun to be had with all things Wonderlandful, so many different concepts to create . . . and we only wish they had chosen a more unique identity. And in the Vaping community, uniting and supporting one another as vapers and as vendors is the most important thing we can do to protect our freedoms. We would hope that all vapers and vendors would treat each other with the respect that they would want bestowed upon them. Congratulations on your new store! I wish you a prosperous and enjoyable venture!
I am concerned regarding the name issue. I am aware of how expensive a name can be. All the labels, the licences etc. However, the name of your establishment is so very close to Alice in Vapeland that I fear it will cause confusion and frustration among shoppers!
Alice in Vapeland has a huge following and is, indeed, a very special vendor. I fully expect your establishment will have the same loyalty and following in time.
Is it possible to change your name? I have seen problems when names are this similar. I refer you to the whole Bobas Bounty issue with the two very similarly named stores selling the 2 different liquids with the same name.

Thanks so much for your well wishes. When we were thinking of names for this shop we googled Alice n Vaporland and the closest thing we got was Alice in Vapeland out of the U.K. We actually have rights to both names not knowing that there was an Alice in Vapeland in Albuquerque. We received a call from them...a threatening call to change our name or else. We do not sell juices outside of Texas and do not feel in competitions with them at all! We spoke with our Attorney and he told us not to worry about this. We have the right to this name and Alice in Vapeland in the state of Texas. We honestly did not have any clue that Alice in Vapeland would blow up our facebook page with terrible remarks. We are just a small business trying to make a living.

OK. this was quick. Here is my message to them and their response. It appears, unless I read too quickly, that they are using the name "in Vapeland" and "in Vaporland" interchangeably in their reply. I really just skimmed so I may have confused myself! Easily done.

Well, back to getting ready for tomorrow morning, but had to take time out to defend MY FAMILY! Which is exactly what AiV is to me!

Alice In Vapeland -- the vapor juice company -- is more than a company to us. They ARE family. A company that popped up with almost exactly the same name and a very thin excuse of "we googled that" (my google gives me a full page of Alice In Vapeland links.. facebook does also) was bound to set off frustration and anger just like any family defending its own. Even from outside of the "defending our own" perspective though, this IS a small community still. People who move from "i'm using an ecig to quit/replace/fly/sit in the bar" to vapers are just not that common. At the very least, choosing to name your business after an established member of the community shows poor taste, and will cause backlash. Confusion and ire will abound. Taking an open minded stance to adjusting your name to minimize that would simply be good business, if nothing else, if you truly wish to be a member of the "vaping community".

It is not likely that you could take any business from them, that is not the point. The point is your flagrant disregard for all the hard work and time that it has taken them to make this NAME important in the vaping community. So, you just come along and pick it up and run with it. It is not your intention to do what? What exactly was your intention?
