Apparently the goal of Matthew Myers is to delay regulation of the products for as long as possible. Otherwise, why would he have urged the FDA to continue to fight against the unanimous rulings of two levels of the Federal Court system? And why would he be joining Amicus briefs in support of the continued, drawn-out, unlikely-to-succeed appeals process?

Why is it that I get the sneaky suspicion that the reason the FDA is continuing this fight is because BP is actually in the process of testing and getting ready to release their own versions on ecigs that will be FDA approved drug delivery devices that will require a physician's perscription to obtain and use?

What's even more amazing is the fact that the FDA apparently does not have the ability to multi-task. That doesn't bode well for their expansion in the food supply. Had the FDA considered that they may have to treat E cigs as a tobacco product when this issue became heated or even when they lost the first round, they could have started the process of formulating some regulations. Instead it's easier to claim them unregulated devices that will be sold to and hurt the children.

While on the subject of the FDA's efficiency, how are they doing on their decision to ban the second most popular flavor in cigarettes. The one they use to hook the kids, menthol. I haven't seen mention of that in months now, are they waiting for the pres to clean up his act?
