It stinks that this guy was hurt. Anyone know if a seller is responsible if they sell a (yet to be proven) defective product?
I don't know about such things.

I don't know about such things.

If the bottle of liquor spontaneously explodes, you better bet the seller would be sued...

In one of the pictures it look s like he had the battery in a zip loc bag in his pocket. (as the pic shows the bag melted to the battery) Was he carrying it like that?

Could keys or change complete a circuit if the battery is in a plastic bag?

not gonna happen. show me one case where someone
that was injured from a cork from a bottle of champagne
successfully suing a liquor store.

I didn't say anything about suing and winning, just being sued; just like the vendor in this case won't end up with a $million judgement against them...

Really? Why are people so dumb? Suing is just the way of life now. Its never their own faults only someone else's.

Suing is a way of life in America. Law suits are the staple of over 450,000 active attorneys in the USA.
The Beatles sang about it;
"Sue Me, Sue You Blues" is a song written by English musician George Harrison from his 1973 album Living in the Material World

If there's any legal fault, I think the negligence
is with the battery manufacturer, not with the retailer.
I don't see why the retailer should legally have to warn customers of the potential risk
in using lithium batteries. Sure, it would be nice if he did and posting signs as he has is
a good thing. But I don't believe he should be liable for damages.

The vendor's insurance company, if he has one. Will likely settle out of court with
the plaintiff. That's the way the legal industry works. But though he could have been seriously hurt,
I think he should be responsible and not need the gub'min and the courts to
reward him for his own stupidity. It's a frivolous suit.

The article is biased. Where it states:
"There is still debate about the health effects linked to electronic cigarettes sold in stores like Vixen Vapors ."
Rather than unbiased reporting of the occurrence
the author sets a negative tone about ecigs and their effects.
