anyone that followed my thread about getting fired for vaping-outcome

it took a total of 6 weeks but i finally got approved friday. they finally called me, i explained that i had no prior warnings..... never got the policy in writing, ect ect. she asked me if they gave my a place to go vape in an afternoon break. i told her no, they told me to quit vaping period. she agreed that really wasn't their place to do that. my wife just got a job at a hospital, they have designated areas to go including the car.... as long as you are out of sight. she said since i had no prior warnings that it was automatically approved no further questions. they cannot fire for a minor offense without a warning before termination and not pay unemployment. sure they can fire you for anything at any time, but they cant deny unemployment in a situation like that. the fact that this was allowed to drag on so long, that's what really annoys me. i hope their unemployment insurance rate goes up. i hope they get in trouble with corp for having a claim against them. i hope they are more reasonable with people that use nicotine in the future and give them a set place to go on break that is acceptable. if they are by themselves and have to leave the plant for 5 minutes, oh well.

so this ends the chapter in my life working for the biggest antz i ever wish to work for. at least its closure. now for complete closure, finding another job before my UI runs out.

Glad it came out in your favor, & they got a lesson in employment law! I hope they get a fine, too!

I retired a few months before I found vaping. Even then, smoking areas were the only place you could light up and no one even thought about vaping. Our company changed their vehicle smoking policy to no smoking. I was out in a company vehicle all day, so that was an issue. I had to pull over and get out to smoke. I was fortunate to be able to decide when to do that.

It must be a pain to work 8 hours inside and only be able to vape on breaks and at lunch. I'd be tempted to vape high nic juice and hit it a few times in the men's room when no one was looking. Nicorette might be my friend for the tough times when I couldn't leave the building.

they expected me to go 5 sometimes 6 hours without vaping. they gave me no place to go except to the unemployment line. they were completely unreasonable, had they at least given me a designated area, i would have co-operated. but they told me to quit, lol. i hope the do not hire any nicotine users in the future. i hope they are getting some medicine right now.

i was not allowed to vape on breaks only lunch. it was an intolerable situation. make matters worse they told me to seek nicotine addiction consoling. they were not good people

Too bad you didn't have the power to take away their coffee breaks. Nic and caffeine are about equal in effect. Both are recognized to have positive health benefits.

Keep this article in your back pocket for the next time you are challenged. Who would refute an article from Scientific American? :)

Glad to hear you are getting unemployment benefits! From the beginning I thought what they were doing/did was illegal or against employment rules. The can't tell you what or what not to do on your breaks or during lunch only make sure you were not abusing the time allowance. Hope the job search is going well!
