One of my favorite vendors just posted this asking if anyone had heard anything about this yet, so hoping someone here may be able to help....

Wow! I read the article in your link, that is shocking! So much hypocrisy, I do not understand where such people form their opinions.

I mean the Attorney speaking states that flavoured ejuice is designed to appeal to youngsters and so that is her logic for banning it. It is a huge leap to go from "tasty flavours", to "being designed for youngsters", since when did flavours become all about kids.

What about the various alcoloholic drinks available in california that are sweet flavoured, alcopops etc. There are loads of products that are tasty flavoured that are for adults only,her argument is totally false logic.

If she wants to see through her logic then she will need to ban every flavoured product that is not for children, otherwise her argument is clearly nonsense.

E cigs are clearly not designed for children, the cost of them for starters, puts them out of reach of kids.

Hmm... I wonder if adult vapers in CA would have grounds to bring a class-action suit against the AG's office for lying about there being a law in place that bans the sales of flavored liquid. Grounds would be that flavors have helped to extinguish the taste for tobacco and the urge to smoke and the AG is endangering the health of these former smokers. Any lawyers in CA care to take this on pro bono (since you can't collect financial damages from the government)?

The response from Jeanne Finberg as noted in that "article" was originally posted by me here on this forum.
That response was sent to me in response to questions I submitted on the website of the Office of the Attorney General of California.

After receiving that response from her, the following conversation ensued...

Thank you for your response, although I did find it very disappointing.

As a member of a very large electronic cigarette forum, I can assure you that adults enjoy flavors just as much as youth do. In fact, it is a common occurrence among electronic cigarette users to eventually come to prefer flavors other than tobacco or menthol. Also, there have been a lot of people that were unable to replace real cigarettes with electronic ones until they moved to other flavors. It turns out that for a lot of people, finding a flavor they really enjoy is what actually enables them to make the switch. These are people that are no longer killing themselves thanks to the availability of enjoyable flavors.

Another concern that I have is that this policy is putting these companies at a competitive disadvantage. Over time it is unquestionable that consumers will gravitate to companies that offer a wider variety of flavors. There may come a time when this policy will make it impossible for such businesses to operate in California any longer.

I believe the Office of the Attorney General really does believe that the flavors are some sort of devious plot to entrap children. Unfortunately, that is not the truth. The explosion of flavor options for electronic cigarettes did not develop from any marketing plan aimed at youth. The driving force behind the desire for flavors comes from the existing electronic cigarette consumers themselves. The vendors are just trying to provide what the customers want.

If your motivation is to protect the public health and safety of our young residents, that can be accomplished entirely by enforcing laws against the sale of electronic cigarettes to minors. There is no need to expand your actions to the point of taking away the freedoms of adult electronic cigarette users who are simply trying to save their lives by removing the harmful effects of cigarette smoking.

The "article" leaves out both my subsequent reply to her, and her subsequent reply to me...

Thank you for your follow up email. Please advise your colleagues that our office has no quarrel with electronic cigarette companies that wish to sell flavored products and are willing to age restrict their website to adults. If the site is actually restricted to adults we do not need to concern ourselves as much with the marketing. Perhaps understanding that option that we suggest to companies that wish to sell flavors to adult consumers will satisfy your concerns.

This is old news, and the conclusion drawn by the "article" posted in this thread omits our subsequent communications.
This makes me think that it is a sensationalist piece designed to draw traffic to that "review" website.

Sorry, I was definetly not trying to draw attention to that review web site, as this is the first time I had ever even seen that site! One of my favorite Vendors was sent the link and she was just very concerned, seeing as how she is in California, so I was just trying to get some feed back for her.

DC2: So she is telling us that the only problem is that the web site is not restricting sales to those over 18. So why does her letter tell vendors they can't sell flavors? Should it not be telling vendors they can't sell any e-cigarettes, flavored or not, to those under 18?

I think perhaps she realized that she has been caught in a lie and then backpedaled concerning her position.

I've been thinking about the position that she was taking in her initial response. It struck me that a parallel situation would be:

SITUATION: Kids buy cigars and hollow them out to insert and smoke other substances.
SOLUTION: AG writes to tobacco stores, convenience stores, grocery stores, gas stations, etc. (i.e., any business that sells tobacco products) and tells them that it is illegal to sell cigars.
JUSTIFICATION: There is a law on the books preventing the sale of tobacco products to kids.

Oh the stupidity of my nation is going to be the death of me.

It's just that the nicotine prohibitionists are now more powerful than the alcohol prohibitionists.
