they advise us not too.. good.. so i'll stay in "don't care" mode regarding health canada.. i remember reading this a while ago.. so nothing have changed for us pretty much.

They still legally sell water .... at the store.. what people put in it is not of their concern.. ecig hardware should be the same then

In order to understand what the a Health Canada Ban means you need to understand the authority granted to Health Canada under the Food and Drug Act the measures that they can take under the Compliance and Enforcement Policy (POL-0001) to enforce the Act. Health Canada does not have the ability to make it illegal and we cannot be charge or arrested for using nicotine, but nicotine is a controlled substance under the Act. The act also can cover devices used to administer controlled substances, like the atomizers. In the cause of atomizers it can be argued that they can be used for other purposes or can be used without nicotine liquid, but the nicotine e-juice is covered. Some of the actions that Health Canada can take against vendor/importers under the enforcement policy are as follows;
- customs activities, injunction, prosecution, forfeiture, public warning or advisory, letters to trade and regulated parties, regulatory stop-sale, search and seizure, seizure and detention, suspension or cancellation of marketing authorization/product licenses, refusal, suspension or amendment of establishment license and warning letter.

They have openly followed up already with customs activities as for the rest I could only guess, but it does seem to me that they have some pretty broad powers in this regard.
I am not lawyer so these is my own understanding based on my personal research. Currently the only way it has affected me is when I am ordering outside of Canada. My orders are being stopped inspected and sometimes turned back. You will find many vendors outside of Canada will no longer ship to Canada. Some say that it will only get worse before it gets better. On the other had they have a hard enough time with illegal tobacco sales and illegal drugs being shipped into Canada. How much time and effort are they willing to take on this issue.

This is a sensitive issue for me, lol. I have a plethora of juices I want to try from out of country... But of course, HC would rather go on a power trip and send them right back to the e-tailer.

It's good that I can buy hardware from wherever I would like, but how much longer will THAT be allowed?

Yeah, tobacco water bongs are legal to sell, but I honestly think that's because if the gov tried stepping in and banning them, there would be droves of Canadians marching on Parliment waving signs and screaming in protest. (imho anyway.)

If they ban hardware on us I don't think there will be a massive reaction and that kinda scares me because I don't have a clue about how to build an atty...

Now I know there are many other reasons why Tobacco bongs are legal (won't get in too deep here) but everyone knows what a .... is!

Not many Canadians know that electronic cigarettes even exist, what it is/ does/ is for, or if it is even remotely safe. It's that alone that worries me about this all, because other recreational electronic devices (Isomerizers for instance) went the way of the ban-hammered Dodo without much of a gripe from anyone.

I don't suspect this will actually happen, but there is always a chance. The greedy Tax Men don't like seeing smokers quit so easily and big tobacco isn't going to be jumping on any revolutionary electronic cigarette bandwagon any time soon... E-liquids make it too easy to wein yourself off the nic for them is my educated guess.

Oh, as a final note, I would be ecstatic if I could walk down the street to my local vape shop and BUY RETAIL EJUICE... lol. I can dream can't I?

Anyway enough of my venting for now, lol

Considering what the 'brick and mortar' locations charge for their liquids, I'd keep that one pretty far down on your wish list..

We're managing and, not with the problems HC would like to THINK we have. All you have to do is take a look around. Closely.

I have gotten used to paying 20.00 and under for my liquid. Unless I am paying for some concentrated NIC I see no reason to be paying more.

On one hand, I agree with you 100%, but, on the other hand, I'd rather spend an extra 2 or 3 dollars to keep our Canadian vendors in business.

A good friend of mine has been a lawyer for 30 years and a smoker for 35. Last week, on my urging, he bought a 510 starter kit and I gave him a selection of juices.

Last night we discussed the legalities of e-cigs and nicquids in Canada. His response was:

"If these become illegal in Canada, I'll sue the government."

He's serious. He's done it before.

That is amazingly awesome! We need more lawyers like that in our corner of the ring right now and it's good to hear of at least one here in Canuckland.

Keep me in the loop as far as the legal end of things go. It may be something to think about some time in the future ... a threatened lawsuit always tends to leave an impression.
