[h=3]URGENT CTA Chicago E-Cigarette Usage Ban 12-9-13

It has been reported that an ordinance regulating e-cigarettes in the City of Chicago likely will be introduced in a joint committee on MONDAY, December 9th, 2013.

We are still trying to confirm details, but it appears that the City of Chicago is deliberately failing to provide advance notice in an effort to eliminate opposition to the ordinance.

We have not been able to confirm details, but our understanding is it likely that the proposed legislation will:

· Require E-cigarettes be sold behind the counter

· Ban sales to minors

· Prohibit distribution of product samples

· Subject e-cigarettes to the Clean Indoor Air Act (can’t smoke indoors)

· Prohibit sales in any building within 100 ft of a school/day care/or for the education or recreation of children under 18

It is imperative that Chicago area vapers reach out to their aldermen--

Absent any last-minute moves by the sponsors, the hearing is at 11:45 AM tomorrow (Monday, December 9th) at City Hall before the Joint Committee on Health & Environment & Finance.

This would ban e-cigarette use in e-cigarette stores (something that even Mayor Bloomberg's recent usage ban proposal doesn't do) and set a terrible precedent for the rest of Illinois.

I emailed every single email on that list, and I have spread the petition as much as possible. I will also be at the city hall tomorrow to raise my voice in this matter. Any and all support in this is appreciated!

Looks like Rahm lost today "Mayor Rahm Emanuel’s plan to ban e-cigarettes wherever smoking is prohibited — and snuff out the sale to minors — ran into a dark cloud of opposition Monday, forcing the mayor to settle for the weaker of two ordinances designed to curb teen smoking.

The City Council’s Finance and Health Committees agreed to snuff out the sale of menthol and flavored tobacco products within 500 feet Chicago schools — five times the existing radius.

But a surprise outpouring of opposition derailed the mayor’s plan to regulate e-cigarettes as “tobacco products” subject to Chicago’s smoking ban."

Sounds like some of the aldermen (alderpeople?) actually *listened* to vapers before making up their minds! Outstanding!!!

(Only downside to this is now we'll be bombarded by pouts from the ANTZ. SmokeFreeIL has already implied that all the opposing voices to the legislation who showed up at the hearing were from "the ecig industry." :facepalm:

It appears that Chicago Mayor Emanuel and his Health Dept director introduced the bill today, and attempted to railroad the bill through Council.

Did any e-cig supporters even testify at today's Council meeting (as the City and City Council hadn't, and apparently still hasn't, even made the bill public, and never announced there would be a hearing today, but invited e-cig opponents to testify in support of the bill)?

We won -- this time.

But I've been watching Chicago City government shenanigans for decades. This was only the first round.

We have to vigilant against future attempts by the Rahmfather to ram something similar through the City Council.

I spent my Sunday talking to vendors and some vapers about attending and I was in communication with them throughout the day.

I'm fairly certain that only handpicked ANTZ were allowed to speak, but I haven't confirmed it. However, I recommended that they show up at 9 AM and start going around to Aldermen offices to meet with staff and many did.

Good job!

Watch out for Rahm. He's known as a backroom manipulator who doesn't like losing -- regardless of facts or who gets hurt. Best bet might be a pact with sympathetic council member(s) to protect everyone's interests and raise a warning flag (maybe email list?) if/when he tries again. Good luck.

Many, many thanks for quickly informing and mobilizing vendors and vapers in Chicago to contact Alderman and attend the meeting. That likely made the difference.

I couldn't find any info about the meeting at the City Council's website (when I tried to listen/watch the meeting).

Is there an end-of-the-year deadline (as is the case in NYC) for this bill to either pass or die?

It appears the ANTZ had a grand plan to try creating a sense of emergency to quickly railroad all these bills through (NYC, Chicago and LA) by the end of the year to prompt other municipalities and states to quickly enact similar bans, and to set the stage for ushering in FDA's proposed regs that will decimate the e-cig industry.

I'd like to be able to counter the "sense of emergency" with the ALA, ACS, CTFK lobbyding to MAKE SALES TO MINORS LEGAL until they get their entire agenda. Doesn't that demonstrate a lack of urgency to protect kids?
