Its interesting the FDA seems to be doing a bit of backtracking on their initial stance. Could it be possible pressure from e-cig users is getting to them?
Vocalek--that has always been the position of the FDA as they state that you can not "Ban" a product that has never been approved to begin with. Rather the FDA wants them to go through the approval process, which is in fact a de-facto ban as SE and njoy argued to Judge Leon. So the FDA is playing with words.
Whoever wrote the oath to be sworn when you testify before court understood that if you don't tell "the whole truth", it's the same as lying.
Too bad when the FDA holds press conferences or provides comments for publication the spokeperson isn't required to take the oath. Wouldn't that be something!
