I'm considering filing a Class Action Lawsuit against the FDA. If anyone is willing to go in on it with me, please PM me or post a reply in this message.

I will also open a poll here for those willing to donate to the Lawsuit. I will not accept any donations until everything has gone underway.

I don't care whether my company is shut down, I'll recover, but to be honest, it doesn't make me very much to begin with. I got into this to do some good, not to get rich.

This is about the government spitting on our liberty and putting our health second to personal, special interests.

Thank you all,
Eric

Not to mention the FDA misleading the public as to the dangers of electronic cigarettes, putting at risk not only my health but my business as well as many, many other suppliers and the livelihood of our families.

Not to mention, they are directly putting our families at risk by forcing us to return to analogs as analogs are known to produce second hand smoke which is not a factor for electronic cigarettes.

I will do whatever I can. I hate it when special interests or big money corrupts government. That is what is happening here and we all got to stand up for our rights.

Special interests and big money doesn't corrupt our government anymore, it IS our government now.

Eric,

Just stopping it to subscribe to this and to keep an eye on the way this idea develops. I found some old threads discussing this in the campaigning section of which you could possibly draw some ideas from.
http://www.e-cigarette-forum.com/fo...-time-file-class-action-suit-against-fda.html
http://www.e-cigarette-forum.com/forum/campaigning/15192-class-action.html
http://www.e-cigarette-forum.com/forum/campaigning/11753-class-action.html

While I do not discount this idea at all as it is completely feasible, especially if an ACLU lawyer picks up on it, because that's what it comes down to: Our civil liberties to be able to pick products for ourselves, especially for those of us who cannot afford the western philosophy but also do not rank low enough on the scale to be offered any government assistance... and those of us who do not ask for government assistance no matter how dire... It is interesting to me how and when this card would be played as you would almost certainly have to wait until a ban was in place to prove that the FDA is actually doing us harm.

It's a good discussion though and if you are serious about moving it forward, an ACLU lawyer would be the next phone call to make.

You can count me in on this lawsuit. I have tried quite a few products that were supposed to help me to quit smoking and they all failed miserably. I even tried prescriptions from a doctor and they failed me also. I currently have gotten into the ecigs because of the fact that for one they are a lot cheaper then analogs, and for 2 I have never felt better. I no longer have the smokers cough and I definitely can taste and smell things a lot better. Even things such as a simple glass of juice do not taste the same since I started on e cigs. They actually have a flavor to them now. So count me in. Let's take it all the way to the top. Also Eric I was wondering if you had seen the post about the FDA conference call. It was interesting to listen to how misinformed they are about the e cigarette. The biggest example would be the fact that they state that e cigarettes are being advertised in every way imaginable. Even to young kids. I don't know where they got that bit of information from as every supplier I have looked at (which was quite a few) did not have any kind of advertising towards children. In fact a lot of them clearly state that the e cigarette is not intended for use by teenagers and such. Well whatever the decision to more forward on this count me in.

Nice to hear someone thinking along the same lines as I have been. I have voiced this to others around me thinking a class action would have merit - this is "supposed" to be the land of the free...free to make our own choices. I believe a FDA ban of the devices would indeed be an infringement of my right to life, liberty, and the pursuit of happiness. I would certainly participate!!!
