Hi, the links below detail the official position of the Danish authorities.

1.) Danish Medicines Agency, 9 October 2008:
www . dkma.dk/1024/visUKLSArtikel.asp?artikelID=14250

2.) Danish Medicines Agency, 9 March 2009:
www . dkma.dk/1024/visUKLSArtikel.asp?artikelID=14819

Essentially, electronic cigarettes WITH nicotine have been classified as medicinal products. Effectively, this made marketing and distribution of electronic cigarettes with nicotine (and nicotine cartridges) illegal in Denmark. The ban is only on marketing and distribution, NOT on personal use or possession. Marketing and distribution of electronic cigarettes WITHOUT nicotine is legal, and no one will snatch your personal device loaded with or without whatever.

Maybe this helps.

Tom - Excellent find. This is how Canada recently found as well. This isn't necessarily a ban. This is basically the Danish authority stating that since we do have control over nicotine, we do need to have a regulatory process over this product if it contains nicotine. And for those who wish to continue to sell the ecig without nicotine, please do not make any claims that would categorize it as a medical device.

I find these to be positive. Sure. They throw a few bumps in the road for small suppliers, but isn't a blanket ban which keeps the market open upon proper approval/testing.

From the 2009 finding as noted by Tom:

"We do not generally consider cartridges for electronic cigarettes that only contain flavour, to be medicinal products. However, we presuppose that the flavours do not have a pharmacological, metabolic or immunologic effect (cf. section 2 (2) of Danish Medicines Act).

Flavoured cartridges may, however, be considered as medicinal products, if the marketing of the product gives the impression that the cartridges can be used for preventing or treating diseases, such as nicotine dependence and abstinences."
