The Denville proposal specifies, as prohibited items, cigars, cigarettes, pipes, “or any other matter or substance which contains tobacco


First-time offenders would face a fine of up to $100, or up to two days of community service. Second time offenders would face up to a $250 fine or five days of community service.


Anyone caught smoking for a third time in a park or recreation area would face up to a $500 fine or community service of at least 10 days, “or any combination of fine, imprisonment and community service determined by the municipal court,” according to the ordinance.

Prisoner 2: I lit up in a parking lot.

Municipal clerk Donna Costello scheduled a second reading, which would include a public hearing and likely council vote, for July 13.

Unless the voters of Denville Township are asleep at the wheel, that should be one interesting public hearing. Meanwhile, the leader of a smoker's rights group in New York is offering to pay the fines for anyone who is ticketed under the law, should it be passed by the township council.

I wonder if they will include E-cigs or have to go back and alter their regulations.

The cops can write you a ticket anytime they feel an infraction occurred. It's up to the court to decide if it's ligit which makes it a pain in the .... in this case.
They really need to spell it out. The way it's worded, snus would be an infraction.
