HTA sec. 78.1(2) states:
No person shall drive a motor vehicle on a highway while holding or using a hand-held electronic entertainment device or other prescribed device the primary use of which is unrelated to the safe operation of the motor vehicle. 2009, c. 4, s. 2.


Any thoughts on that? PV does qualify as a handheld electronic device (albeit not entertainment) and it sure sounds like the primary use of the device is not related to safe vehicle operation.

Any cops here would like to fill in?

and if its a repost, oh well.......

see I chipped my tooth... I still see people holding cel phones to their heads all the time. I'd like to see them crack down on that more. I got smoked by a woman talking on her cel phone. I was driving in the lane to her left right beside here and she never even looked and drove into my car.

dripping and driving is silly. topping a carto or filling one same deal.

With the new distracted driving mandate (read:cashgrab), I personally viewed in Kemptville the OPP sitting at the traffic circle issuing tickets to people leaving the Tim Horton's drivethru and opening their coffee as they drove. So, it appears as though ANY distraction from the course of attentive driving is an opportunity to earn yourself a ticket.

Vaping and driving I don't see as any more of an issue than smoking and driving. But if you're dripping, wait until your vehicle is at a complete stop at a red light, etc.

I've vaped in traffic stopped right next to a police cruiser, and other than the normal looking around and scanning their surroundings, the cops didn't look twice at me. Even when using the steering wheel as support while dripping at the light.

Whichever device I bring with me, it just has to fit in the door handle pocket in my car, so it's easy to access without looking. As you can see in the picture, it is perfect for small devices.

Totally correct :) I just wonder if anyone has ever been ticketed for smoking and driving?

thats the part that concerns me.... whats a "prescribed device"? And technically speaking you can get a careless driving charge for just about anything if the cop doesnt like you

Interesting... so anything Madam Wynne thinks is illegal to use will be so

To think that something as simple as listening to music or using a PV can be ticketed is just appalling. How much more will people take?

It's sad to admit that you can end up broken financially, arrested or brutally beaten these days if a cop is in a bad mood. Look at Officer Bubbles... Now that being said, not every cop is a walking ....er and I'd bet most wouldn't charge someone for no good reason. Cops are people too after-all :) You get good eggs and bad eggs as with everything in life

the driving law is a good one in many other countries the driving laws are way worse , at least we can still have a coffee or a snack
some places it absolutely illegal to have a coffee or a water while driving
others if u loose your licence once u never have the opportunity to regain it
some places if you get stopped drinking and driving everyone in the car gets charged with being an accessory to a crime
our driving laws are weak compared to other places and driving claims a lot of lives every day
its only excepted to need to crack down on distracted drivers i personally hate them and think its very ignorant to put others in danger by multi task driving

lol i just had to take a drunk driving course and i learnt alot

Well i understand completely, but drivers should have the right to drink water or coffee at least IMHO. I hate it when I see people yakking on their phone or trying to text someone, but there is a line where it becomes a little ridiculous to control drivers at such a harsh extent like opening their timmies when they bought it at a drive-thru.

Everyone SHOULD get charged in a car if they let a drunk person behind the wheel, I'd support that bill.

We let our lawmakers make laws that are ambiguous. Mainly because no one seems to take an interest in it or when people do, the lawmakers drag out one of the trump cards, "Safety for the Children", "Violent Criminals out on Parole" or in this case "Safer driving". Too much apathy. Until we have cops giving people tickets at Tim Hortons etc.

Our Cops are too busy ticketing bicycles for not having bells on them to stop someone driving distracted.
