E-Lites have just received a court decision and have won our litigation against the Estonian State Agency of Medicines regarding sale of E-Lites products in Estonia. (We believe that this will apply to other electronic cigarettes in Estonia.)

According to the decision the court has ordered Estonian State Agency of Medicines to reconsider the application of Zandera Ltd (the company behind E-Lites) regarding the sale of E-Lites products in Estonia. The court has also decided that the Estonian State Agency of Medicines is obliged to some costs to Zandera Ltd for compensation of the litigation costs.

The decision will come into force if it is not appealed during 30 days in Tartu District Court. Now we must wait whether the Estonian State Agency of Medicines will dispute the decision in Tartu District Court or not. If the decision is not disputed we will ask the Estonian State Agency of Medicines to make a new resolution according to the court decision and to classify E-Lites products not as medicines. This would enable E-Lites products for sale in Estonia.

We hope that this case will set an important precedent in the overall fight against medicinal regulation of electronic cigarettes across Europe.
