I am writing to you in
relation to the sale or supply of electronic smoking
devices or electronic cigarettes containing nicotine intended for human use
.

I wish to inform you that the Minister for Health recently amended the
Victorian Poisons Code made under section 12 of the Drugs, Poisons and
Controlled Substances Act 1981 to include nicotine for human use when it is
included in Schedule 7 in Chapter 1 Part 2 List of substances that are not
for general sale by retail. The effective date of the amendment is 1 January
2009.


The effect of this is to prohibit from 1 January 2009 the sale or supply by
retail of nicotine for human use when it is included in Schedule 7. Retail
sale would constitute an offence against regulation 65 of Drugs, Poisons and
Controlled Substances Regulations 2006. Products affected include electronic
smoking devices or electronic cigarettes containing nicotine intended for
human use.

This brings Victorian controls into line with controls in other States and
Territories.

wow , i just came from eciggy ,having made a bit of an order :D
looks like it is hitting the fan big time
i feel sorry for eciggy.com and anyone else really who was going in for the retail side of things , i contemplated it months ago but though to wait and see what happens , kind of glad i did
should still be ways and means of getting stuff , lots of things are illegal yet easy to obtain
i always thought that once the government realises the threat to taxation that ecigs are , that they would move in for the kill
all they care about is money

Just FYI, here's a copy of the email I sent to the NSW Health tobacco resources people today.

Dear Resources Officer,

I read today about the state of Victoria banning the sale and use of 'battery-powered cigarettes', also known as 'electronic cigarettes' ( VICTORIAN BAN ON BATTERY-POWERED CIGARETTE - Premier of Victoria, Australia ). I have since read some rumours that similar bans are planned for NSW, and would like to know more about these plans, if indeed the rumours are true.

I have been using an electronic cigarette for three months now, and am concerned that if they are banned I may end up returning to smoking of tobacco products. I would like to know if there have been any studies conducted in Australia that have demonstrated health risks involved in 'e-smoking' that do not apply to other (in my experience, less successful) nicotine replacement methods like patches and gum. I would greatly appreciate it if you could let me know if you are aware of any plans to ban the devices and refer me to someone who might be able to give me more information on the plans.

So how does this affect your ability to use 'personal vaporizers' with 0 nic liquids? It seems they are tying them in to nicotine delivery.

It seems that in the Australian State of Queensland at least that QLD Health have found that even use and posession are illegal. Due to them saying that they are a dispenser of a "regulated poison".
 
Any ideas on how we can fight this? As you may have read in my other posts, not only the sale, but now the use and posession of an e-cigarette is illegal in QLD due to the wisdom of QLD Health.

I just cant enjoy a vape outdoors now, as Im constantly on guard looking for police etc. :(

Something really needs to be done before other states follow suit.

I guess it might be wiser to get hold of (or make) 'uncommon shapes' for your vaporizers too. Perhaps go the route of making them look as much as possible like asthma-inhalers? And perhaps use, at least out of doors, the original Ruyan-liquid, so hardly any or no smoke is to be seen?
Really sad... hope some higher-ups see how stupid they are acting real soon...

I'm sure that isnt true. Surely there IS something we can do about it? Write to the local member maybe?

Fellow Brisbanite here. I only discovered e cigs this week. I'm getting them for my mum, who has been a very heavy smoker all of her life, who had a heart attack last year, and who I am very very lucky to still have after her making it through the night when the doctors said she wouldnt.

I personally will be looking at getting some for my dad as well, and if they are better than nicotine patches or inhalers, then i will be a talking billboard and will be converting as many people as I can.
