I Have got product manytime from this place, IMO they have the best customer service, Very fast shipping i get my product the next day if i order by 12.00 pm All genuine parts and products.Plus they are Good old Canadian Boy. Who opened a retail store in canada not allot of people have the marballs to do that.

They've been open since October 2010. I shop in person there all the time. I get most of my 510 Cartos there which I believe are SmokTech XL 1.7LR's, House-branded w/logo as eVape for $9.99. They give Really Good vape! They also absorb and hold juice better then Boge LR's. Those eVape Cartos and the Kangers are the two best Cartos I've vaped from hands-down. It looks like eVape are going to carry the Kangers too, they had some sample packs in last week which are now gone .

Another thing I like about the eVape store is they have a list on their wall of all Local vape friendly businesses! Places you can freely vape without having to explain yourself to staff. A list of local Bars, restaurants, Auto Parts places...

That is so cool. I would only support establishments on the list as long as I could get everything I needed from them.

What I'm asking is why Health Canada can't do anything if the MSDS is attached.

MSDS doesn't give them authorization to sell nicotine. eVape doesn't sell nicotine juice.

That's why brick and mortar stores aren't a reality yet, and why the "current state of affairs with Health Canada" is affecting the industry. The vast majority of users want nicotine.

I don't think Lucky realizes the issue with Health Canada is nicotine and no MSDS will change that.

Well it must be on the down-low then. As far as Health Canada is concerned, nic juice is a schedule F drug and not authorized for sale. No MSDS will change that.

At this time, the Health Products and Food Inspectorate (Inspectorate) is requesting writtenconfirmation that your establishment has ceased importing, distributing and selling electronic smoking products. The Inspectorate is also requesting the identity of your current supplier(s) for any nicotine-containing electronic smoking products.

Your written response is requested by March 31, 2011. Your response must be submitted to the Health Products and Food Inspectorate Operational Centre in your region.

Appendix

Federal legislation pertaining to the importation, manufacture and distribution of drug products, including electronic smoking products, in Canada is established under the Food and Drugs Act and its associated Regulations. These requirements include market authorization and licensing.

Market Authorization - DIN
Per Section C.01.014.(1) of the Food and Drug Regulations (the Regulations), a Drug Identification Number (DIN) must be assigned to a drug product before it can be offered for sale:

No manufacturer shall sell a drug in dosage form unless a drug identification number has been assigned for that drug and the assignment of the number has not been cancelled pursuant to section C.01.014.6.

Market Authorization - Device Licence
As per section 26 of the Medical Devices Regulations, a class II, III or IV device licence must be issued to a medical device before it can be imported or sold.

Subject to section 37, no person shall import or sell a Class II, III or IV medical device unless the manufacturer of the device holds a licence in respect of that device or, if the medical device has been subjected to a change described in section 34, an amended medical device licence.


No person shall import or sell a medical device unless the person holds an establishment licence.

Establishment Licence Requirement
Per C.01A.004.(1) of the Regulations, an establishment licence (EL) is required to fabricate, distribute, import, package/label, wholesale, or test drug products:

Subject to subsection (2), no person shall, except in accordance with an establishment licence,
(a) fabricate, package/label, distribute as set out in section C.01A.003, import or wholesale a drug; or
(b) perform the tests, including examinations, required under Division 2.

Pursuant to section 44 of the Medical Devices Regulations, importers and distributors of medical devices must hold a medical device establishment licence.

No person shall import or sell a medical device unless the person holds an establishment licence.

If eVape has been authorized to openly sell nicotine juice, they are the first in Canada and the first I've heard of it. It also directly contradicts Health Canada's advisory regarding ecigs.

I totally agree. It needs to go to court. But no vendor has done so yet. Quite a few have just closed their doors for good due to these letters.

A member on here even sought legal counsel on this issue. PM Rachelcoffe if you're curious about how that turned out.

Additionally, the Consumer Product Safety Act has given Health Canada new powers and larger fines and penalties for non-compliance. It also makes it much more difficult to actually be in compliance. Even for innocuous herbal supplements.
