I knew when Evolv filed for US Patent for (VW) this would eventually happen.
Let the market fatten up, then move in for the easy money.

I will never own a Evolve piece for this very reason.

Watch out Provari

Is Evolv (or anyone else for that matter) Not provided Patent Protection and or the Right to Seek a Remedy for US Patents that it Holds?

The pessimist in me thinks maybe evolv know something about what's coming from the FDA and are looking for a big payout to sail into the sunrise with, the realist part of me just thinks at a time when vaping needs to be cohesive this is just out of order and yeah I will never consider an evolv product in future. This just stinks of jealousy over the success of the rx200 and evolv probably thinking the reuleaux mod design was only going to be used for their chip.

yes, if they can rightfully patent it. I don't think that holds true for re-purposing existing tech. Variable wattage regulators have been in use long before the vape world started using it.

That depends on if the patent is actually valid. Like I said before, Prior Art invalidates a patent. If someone else in this world had a chipset that allows for variable wattage settings and wattage regulation in the same way that Evolv chips do, and had that chipset before Evolv's, then that's considered Prior Art and means Evolv's patent is null and void. A patent isn't valid if someone else was doing it before you.

Case example... Apple's Swipe to Lock patent which was nullified in both US and German courts.

Never said they didn't.
Wondering (no I'm Not) why they waited until 2014/15(?) to file for the patent on VW?

Found this interesting 4-6-2012
1 Enter power into b0 (manual power set point)
2 Measure V -- put into b1
3 measure I -- put into b2
wait 1
4 let b3 = b1/b2 (resistance of load)
5 let b4=b1*b1/b3 (power to load)
6 if b0>b4 then increase V
7 if b0<b4 then decrease V
wait 2

start:
8 Measure V -- put into b1
9 measure I -- put into b2
wait 1
10 let b4=b1*b1/b3 (power to load using new V and old R)
11 if b0>b4 then increase V
12 if b0<b4 then decrease V
wait 1
Variable wattage module

Really depends on What Type of Patent Evolv has or is Pending? There is a Big Difference between a Utility and a Design Patent.

Priority filing date (i.e the date on which is was first submitted) is October 2011. It was published 3 years later - this isn't unusual.

Like I said, it Depends on the Type of Patent that Evolv holds or is Pending.

Video Cards in PC's have been around a Long Time. And they All do Basically the Same Thing. But that Doesn't mean that if I come up with a Unique "Design" and can get my Design Patented, that I can not be afforded an amount of Protection if my Design is Directly Copied.

It's a utility patent, and it definitely covers VW. Prior art? I very much doubt it - October 2011 is a long time ago, and the Darwin was definitively the first device to do VW

Litigating Utility Patents is what Many Lawyers Dream about at Night. Because the Fees can be Ginormous on Both Sides.

Holding a 2011 Utility Patent is about the Golden Ring on the Merry-go-Round.

BTW - Here is an Interesting Thread. Notice the amount of Time from Application to Granting.

VV patent to issues next week

Kinda funny. During all the clone vs. authentic debates, people said the modder should've protected their work. "They asked for it". Evolv DID protect their work and the same people seem to have a problem with it. Hilarious.
I hope evolv wins. Without evolv, they'd have nothing to copy.
