They can't regulate it as a drug delivery device. They can still regulate it, or more correctly the juice portion, as a tobacco product.

what would the ramifications had been had the ruling gone the other way??? imagine the chaos if no more orders from china would be getting in.

Had it gone the other way, it would have essentially meant it was taken off the market for years until it was actually proven to be safe. So, if you go for the silver-lining, accepting that it is not proven safe and is a tobacco product keeps it on the market.

I know that just to be safe I used my 40% discount at Gourmet Vapor to secure two 500ml bottles 1VG, 1PG for inusuance. this whole FDA regulating eJuice thing probably wont show itself for a while. Why take chances.
