E-cigarette companies and consumers are urged to participate to find out how FDA plans to enforce internet marketing restrictions/bans in Chapter IX of the FSPTCA (that now apply to cigarettes and smokeless tobacco) against e-cigarette companies if/when Obama FDA's unwarranted "deeming" regulation is approved.

Whatever happened to states' rights? States did a near perfect job regulating tobacco before Obama and the progressives ushered in FSPTCA in 2009. For example, by April 1998, every state had a minimum purchase age of 18 or 19.

I strongly suggest watching by everyone interested in FDA enforcement of tobacco (or e-cigarette) ads or sales via the internet.

Since Obama was reelected, the FDA is going to propose the deeming regulation (to apply Chapter IX regs to e-cigs).

This could have a huge impact on ECF and other e-cigarette forums.

It was interesting but no mention of e-cigs. You can see how their logic works though and if e-cigs were placed into certain categories, then misbranding and aldulteration would come into play immediately.

There was mention of cigars and how none of the current regulations apply to them because the regulations have to be created for that specific product. They did not mention anything about upcoming or planned regulations for cigars but you can tell they see they are not in place.

There was one segment where they were showing why warning letters were sent out and the statement that was on the website was not a claim or anything but it was a mention of a manufacturers older slogan stating that they had the 'lowest tar' than everyone else or something like that. The slogan was created in the 50's(I think) when filters were first introduced. Even though the company selling the product stated that it was a slogan, just the presence of it caused them to get a warning letter..

Bottom line for now is not to claim anything about e-cigs other than that they are e-cigs. Say nothing that isn't proven, like 'no tar' 'lower chemicals', 'healthier' etc..

Doesn't mean that they'll leave us alone but any claims of any type are on the radar.
