It didn't have anything to do with the smoke-free law. Technically package liquor stores are not permitted to sell e-cigs because they are not actually cigarettes made from tobacco. I will be working with my state organization to have them added to our commodities list, but I expect that will take some time. Since I wasn't allowed to sell electronic cigarettes in the first place their request that I remove the inventory within 24 hours isn't unreasonable.
Although you seem to view the 24 hour ATC directive as a non-issue, I note from a June 2006 "Package Liquor Store Commodities" list the following: "5. Tobacco products which include any products made from tobacco and any accessories used
incidental thereto. ". It seems to me that a reasonable argument exists that nicotine containing e-liquid is a "tobacco product" and that batteries and atomizers/cartomizers etc. are "accessories used incidental thereto". I have noted that some combined package liquor/tobacco retail outlets in Kentucky (although different laws) do sell e-cigs and e-cig supplies. However, I have not found such a Kentucky store that sells nicotine containing e-liquid separately. I presume that snus can be and is sold in retail package liquor stores in Indiana.
