Just yesterday i went to go buy juice from my local vape shop (there are 2 where i live) they said health canada contacted the mall that the store is in and told them they are not allowed to sell nicotine in the products anymore. And of course the mall agreed so if they break the law they get removed as a vendor in the mall, they have started a petition because this is friggin ridiculous the way the mindless Govt & health canada members look on e-cigs.. & the guy also said there trying to shut down the other vape store aswell :glare::glare:

health canada has no authority legal or otherwise to shut down anything at all.
there is no law that allows them to do so.
it seems they are trying to bluff the land lords now with there non binding
cease and desist letters.
there are other posts here from shops that have gotten so called letters from
health canada and more or less told them bug off.
nothing has happened.
tell the store owner to open his doors and sell his products.
the mall and health canada have no legal authority to stop him.
what he's doing is perfectly legal.

But the mall agrees with health canada for them not to sell nicotine, and the mall has all control over the vendor - so any discrepancies they can just shut them down since its not the vendors property, make sense
?

Then that mall should not be rewarded with rent. Simple. The vendor should find a new location.

If the mall shuts 'em down 'cuz they let themselves get suckered by an gov't agency clearly out of bounds and without a legal leg to stand I'd sue the living cr.. outta them.

they dont need a valid reason to kick them out of the mall though, its there property, they choose who sells there and what - unless they signed some sort of contract when the vendor has like a lease on some space for a year or two. even if they do stay there nowon is gunna buy 0mg juice for them to even break even with money & these shops are pretty small so sueing them would just be a financial disaster

here is a quote from health canada right off there website

" Electronic smoking products (i.e., electronic products for the vaporization and administration of inhaled doses of nicotine including electronic cigarettes, cigars, cigarillos and pipes, as well as cartridges of nicotine solutions and related products) fall within the scope of the Food and Drugs Act. All of these products require market authorization prior to being imported, advertised or sold in Canada. Market authorization is granted by Health Canada following successful review of scientific evidence demonstrating safety, quality and efficacy with respect to the intended purpose of the health product. This evidence is provided by the sponsor seeking market authorization. To date, no electronic smoking product has been authorized for sale by Health Canada."

then the mall would be civally libal for the venders losses.
tthey have to have a legal reason to shut down the vender.
they can change there policy but,if the vendor has a lease
that cpold be a problem for the mall.

thats what they say.
it does'nt change the fact they have no legal authority to ban it
or authorise it for that matter.
