about 2 years ago, I bought a bunch of clove cigarettes from overseas, tax free. If those were not stopped at the border, then I really don't see how e-cigs would be. It is too bad for our local shore suppliers, but there will still be access.

Ahhhh.... 'cause e cigs are a drug delivery device?
Clove cigs don't even have Nicotine... do they?
I see big differences.

they sure do have nic. more then most standard cigs. Come on though, like I said, I did not pay taxes on them, and they were a brand which is not even available in the united states. The government is in the money making business. you really think they would pass the opportunity up to block my tax free cigs if they had the choice?

Kennedy didn't author the bill. Attaching his name to it in front of the actual author is a little disingenuous.

As far as the FDA's ability to staunch the flow of e-cigarettes into the US goes, they don't have a chance in hell. They can't even stop the import of prescription drugs from Canada. How are they going to stop PVs? Answer: they won't be able to. They'll try to frighten suppliers by blocking some imports and hope that the others get out of the business. There isn't enough manpower available to throw down a hard lock on every shipment coming into US ports.

Imported cigs have been "banned" for quite sometime because of tax issues..........

I used to get cigs all the time from Europe and the Ukraine(at less than half the price). I would order 6-8 cartons at a time and the suppliers would only send 2 cartons per package to decrease the chance of getting them seized. While it never happened to me, a co-worker did get some seized. He got a nasty letter from customs that essentially said "If you want to claim them, we will have to investigate and pursue further
or you can consider them seized because of no tax stamps walk away and we will drop the matter"

Needless to say, he did not pursue it.:oops:

You're right, they can't. The only real shipments on hold is huge shipments destined for US distributors (Smoking Everywhere, VaporOptions, etc) with a VERY small number of individules shipments being held (and most of the time released after a few days). My China order came through without even a single stop in customs.

I mentioned this in an earlier video I made. The worst that can happen is your order will get held up a day or so. That's basically it.

I had the same experience until recently. My package from Ruyan is sitting in the customs right now according to the tracking information. Not sure what will happen. It is about 20 atomizers, 20 carts and around 150ml of eliquid. I assume they can't ban the import since these things are not illegal yet. So I am guessing that they will want to tax this. What kind of tax rate would they use?

Flavored cigarettes (with the exception of menthol) are on the fast track to oblivion, yes, with the passage of the Kennedy/Waxman monster....

I think the legislation said within 6 months, all flavored cigs (chocolate, vanilla, clove, etc) will be banned.


I found this in an article about the FDA's new authority over the tobacco industry and their move to ban all flavored cigarettes (except menthol, which is ridiculous and obviously biased due to their popularity in minority and low-income smokers, but still pose the same issues as any other flavored tobacco):

In the longer run, aggressive FDA efforts to reduce nicotine content — the bill prohibits an outright ban on nicotine or cigarettes — could "stimulate as dramatic a change in the product as anything we've seen in the last 50 years."


So, if the bill prohibits a ban on nicotine we shouldn't have to worry about being able to aquire it, and as long as we have access to the nicotine, making our own e-juice is no problem. We can flavor it ourselves. I don't see how the devices themselves can be banned, since calling it a drug-delivery system is innacurate. We don't HAVE to use nicotine in the device. Besides, by that logic, a coffee machine is a drug-delivery system. (Or whatever is a better example than a coffee machine, but you get the idea ;))

Did you use the China Air ship option? I can say that I noticed a warning on the ruyan direct page that your shipment would be in danger of being held if you chose the other option and Ruyan would not take responsibility for those shipments. The FDA is stopping, seizing and refusing these shipments FYI

Let me know as I too am about to order.

I used the more expensive/faster shipping option -- EMS (? or something like that). I just looked at the tracking report few minutes ago and it has been updated with "left customs". Not sure exactly what it means, if it left customs and is going back to China or if it is going to me. (BTW, the tracking I am looking at is not done by EMS but by UPS). I'll let you know if there is any update.

Exactly. I really wouldn't panic until it gets past 5 business days. I've had a few orders that have sat for 4-6 days...............

My order got submitted to customs on the 4th and released on the 5th, the mailman just delivered it a 1/2 hr. ago.

I just placed an order with Ruyan and I took the cheapy way to ship. I'm so cheap. LOL. I will see how it goes with my order. Hope all goes well.
I always used the cheap option when I ordered before. Never any problem. But this time I was adding/removing items from the shopping cart and found a combination that made the faster shipping only about $3 more expensive so I went with it. This is also the first time I ordered juice from them so I thought the faster service may help.
