Came across stories from the NY Times and Washington post which discuss how a federal judge ordered the FDA to stop blocking the importation of e-cigs. There are links at the top of both stories where you can send an e-mail to the editor/ writer of the story. it would be great for them to run another story of how the FDA is now ignoring the judges orders and basically giving the finger to the judicial process of the USA!!

An excerpt...Appeals Court upholds preliminary injunction against FDA to stop seizure of electronic cigarettes

In a straightforward decision, a Federal Appeals Court has upheld a preliminary injunction against the FDA to stop the seizure of the electronic cigarette as it enters the country to suppliers that retail them to the smoking public.

I think the date is just a typo because from what I remember Judge Leon did not make his initial ruling over a year ago or has my memory totally failed me?
Judge Leon made his ruling last January. In December of 2010, the appeals court upheld his ruling, but as Tybin said, the ruling only applies to njoy. It would appear that the FDA intends on continuing to seize products from other manufacturers.

Last Friday I had ordered over $400.00 worth of stuff from China. Then I read the stories of people having their stuff taken by customs per FDA orders. It looks like I got lucky. My package was delivered. I hope others are as successful as I was. All I know is I am ordering from US suppliers until this whole FDA crap is resolved. I can't afford to have my stuff confiscated.

he did but as the NY times article says:


The Food and Drug Administration issued a brief statement: “The public health issues surrounding electronic cigarettes are of serious concern to the F.D.A. The agency is reviewing Judge Leon’s opinion and will decide the appropriate action to take.”

Notice how they referred to his RULING as "opinion" and then went on to say THEY will decide what action to take.I am a democrat and I believe in some regulation but there needs to be a balance.The fda has done the public a lot of good over the years but this is taking things way too far!! it is not democratic. Im a little disenfranchised at the moment.As long as tobacco is out there KILLING people ecigs should be available as the alternative plain and simple.

Not every decision the FDAhas made in the past has been for the good either. Let's not forget that. Also we have courts and judges for very good reason. If judges decisions are allowed to go ignored where does that leave us? That sort of thing could have further repurcussions than just our little community in the long run.
