Agreed about being irked. I don't understand the logic, other than "it's for the children" bull. No smoking bans (even in bars where people are over 21) were put into place because 2nd had smoke was proven to be bad for people (non-smokers around). They were not put into place because "we don't want our children to SEE you smoke".

Honestly this doesn't bother me in the slightest. I just started vaping a couple days ago, however I got an Inferno which looks nothing like an analog. If people really want to use them in public, they shouldn't use ones that look like analogs. Not to mention the people that would go out of their way to make something to smoke actual tobacco and look like an e-cig. Those few ruin it for the rest. As far as making it required to be 18+, it contains nicotine which is addictive, not a toy for a kid to be playing with.

* I don't agree with the smoking laws, however I do comply with them and don't push it by looking for "loopholes"*

Yeah, maybe that's what irked me about the story mauzey. vaping is not smoking. If smoking bans are in place because of the health risks of 2nd hand tobacco smoke to others I don't understand why vaping would fall into that category. It's more like a ban on anything that looks like smoking, whether or not is causes harm to others.

Exactly! There is no end when they start banning things that somebody perceives to be harmful.

Oh totally! I don't think kids should be vaping at all. Even if it was legal (which I doubt!) it would bring down the wrath.

As a side note, when the smoking ban passed in Washington State the law specifically said because of second hand smoke damage to people in the service industry - NOT kids.

Almost everyone agrees that sales of e-cigs and juices should be restricted to those 18 and older, at least until it is proven not to cause harm through clinical studies. Minors do not have the same right to decide for themselves what risks they choose for themselves.

With that said, in my opinion the following also applies:

1st - This isn't anymore a "loophole" than chewing nicotine gum. It's not illegal within the definition of the law and the government has no right to ban an activity that is sanctioned as acceptable by the personal property owner, as long as there is no "evidence of harm" to others.
2nd - Not all e-cigs and e-juice contain nicotine
3rd - What a model of e-cig "looks" like should be irrelevant and telling someone else what their PV should “look like” before they should be “allowed” to use it in public is unbelievably arrogant. Why would anyone think they have the right to tell another adult what they should or shouldn’t use? This is America and if it is not causing provable harm to others, it should be up to the personal property owner to regulate what activities they allow on their premises.

As for the "loophole" I was actually referring to those idiots that decided to start lighting analogs and trying to pass the smoke off as vapor, it's those people that are going to ruin it for everyone else.

And of course, this IS America and if you purchase property for whatever reason, you should be able to dictate what your guests/patrons can do, within reason. Smoking is not illegal and honestly if you dont want to be around it, don't goto an establishment that allows it or work there. Next they'll be banning concerts for causing damage to people's eardrums -.-

How would one find out of the board of health actually has the authority to change a piece of legislation that was created through the initiative/referendum process?

I would suggest that if they feel the need to alter the existing law, it must be done through the process of popular vote, the same way it was made.

PS : I don't even live in king county, but this has gotten under my skin.

As much as I appreciate all the well-thought out letters and emails being sent off, there is clearly no logic behind the move itself, and I would not rely on a logical solution.

I've sent my fair share of mail to legislators making poor decisions, I think in this case I want to find a way to make them defend their position with facts, and in comparison to other products which fit their new classification/standard. The burden of proof is on them. They are the "board of health" not the "board of social norms". Their complete disdain for the health of their population is pathetic.

I really have no idea what I'm doing, but I want to make some noise.
