Hey all,

Been out of the ecf loop for a while... I'm actually trying to start an e-cig brand.
Question tho:
Is anyone aware of any law suits against e-cig companies? Such as a product liability suit -- someone drank the e-juice, or whatever.
My guess is that it's too soon for something like that to come up. But I figured this would be the best place to ask.

Any feedback is appreciated.

I haven't seen/heard of any lawsuits either. I would think as long as you have a disclaimer and safety warning about the dangers of nicotine and use child proof caps, you wouldn't have anything to worry about. It may also be worth asking a lawyer about it.

Yeah... You'd think that.
Just cause you say buyer beware doesn't mean they still won't try to take you to the cleaners. Win or lose, it still costs money.
The other eyebrow raiser is the fact the Product Liability insurance for e-cigs is INSANELY expensive.
You can do business without it. But I wouldn't.

I was thinking about this the other day and thought it would be effective and in my opinion funny to put "not intended for human consumption" on the label. Just as a blanket protection for all to stop any lawsuit from coming up and placing the responsibility on the end user. But realistically that would be counter productive to the e-cig industry as the FDA would probably jump all over that. I wish personal responsibility existed in the US.

Back to reality. I would take every precaution imaginable seeing as we live in such a litigious society.
