KUCHING January 7 - Selling, distributing or storing electronic cigarettes, e-Cigarette is an offense under the Poisons Act 1952 and Regulations of the Control of Drugs and Cosmetics Regulations 1984.

State Health Director, Datuk Dr. Males Zulkifli said, it is so because the government has to detect the presence of liquid nicotine in e-Cigarette in a certain concentration range.

He said, nicotine is a substance controlled under the Poisons Act 1952 and exempted only in tobacco products.

He said the sale and supply can only be made by a licensed pharmacist and a registered medical practitioner.

"Violation of this requirement is an offense and punishable by a fine not exceeding RM3, 000 or imprisonment not exceeding one year or both, under the same Act.

"The allocation is also subject to other chemicals that were detected in the liquid e-Cigarette if it is a controlled substance under the Poisons Act 1952, "he said in a statement here today.

The warning for the state Health Department e-Cigarette claimed as smoking cessation aids sold widely and got a warm welcome in the state.

It is marketed in liquid form using a set of e-Cigarette to produce vapor in electronic cigarettes.

Meanwhile, Zulkifli said that nicotine is the issue that needs to be registered under the Control of Drugs and Cosmetics Regulations 1984.

He said violations are offenses with fines imposed not exceeding RM25, 000 or imprisonment not exceeding three years or to both.

He said, to a body corporate, the penalty can be imposed under Section 12 (2) is a fine not exceeding RM50, 000.

"Therefore, all dealers that have to do with e-Cigarette reminded that an offense if storing, distributing or selling of any materials or other liquid containing nicotine native cigarette or tobacco, "she said.

I find malaysia law irritating as their drug and other substance laws have not been reviewed since 1952.... >.<
