Medical malpractice on a massive scale

Just out of curiosity how are anti smoking groups and the FDA committing medical malpractice? They have doctors that work for them and I'm sure they have tons of doctors within the organizations themselves. But they aren't a hospital or doctors office that actively cares for patients. They are an organization the either approves or disapproves items that are to be used for human consumption or in the case of anti-smoking to abolish tobacco outright. So just how exactly are they committing medical malpractice in accordance with the law? At best because of their false accusations and such they are at best to be accused of libel and just being a big group of idiots. As for medical malpractice I'd like to see someone actually try to take it to court on that matter. It would be laughed out of the court room quicker then the Flash could run across the United States.

They are, through reprehensible ignorance, criminal intent, or negligence failing as a professional institution to render proper services. The result of which can be a manifestation of injury and loss of life and money. They are misconducting themselves and misrepresenting a product.

That answers the malpractice issue, as for the medical addendum it is indicative of the nature of the product. Such blatant and biased opposition as the FDA has shown would cause users and future users to incur a plethora of medical conditions from discontinued use. Also, the employment of scientists and doctors to perpetrate these findings--which are so skewed in favor of their litigated goals--even against their own peers better counsel is unethical and immoral.

If nothing else malpractice is in play and quite obvious, if you want to bend the argument on the medical justification of this report fine. The report for the most part is to show the glaring errors that are being made by the FDA, law makers, and the media. Is this colorful wording used in the title any different then what newspapers and news casters do everyday on TV? Is it worse then what one reporter said "Those E-cigarettes look strange so they must be bad."

Thank God we have a sane and vocal doctor like Dr. Siegel on our side. The rhetoric from Big Pharm and the FDA is getting silly and I believe it is getting to the point of malpratice. The reason it is malpractice is they are misusing their position of power to spread misleading information that can be harmful.

I've been kinda silent in a lot of these types of threads specifically because I wasn't surprised by the FDA's very careful, and very political move. I live close to DC. You can feel the power of the tobacco lobby here. A quick trip through the touristy areas, and you can see the tobacco leaves on our most famous monuments.

Wow...that's pretty good. Now how do we get this to EVERYONE who isn't on this forum??

We need to have this article handy any time someone questions us on the safety of vaping. The major news organizations are pathetic when it comes to actually trying to see more than one side of an issue.

It's floating around here... The Rest of the Story: Tobacco News Analysis and Commentary and on the web. Dr. Siegel gets pretty good coverage.

Dr. Siegel is a huge proponent of the electronic cigarette. His posts are always informative and all of us should have his blog in our feeds.

He is an anti-smoking advocate who has basically been shunned by the anti's because he believes that steps towards harm reduction instead of the "quit or die" philosophy is the way to go. :thumbs:

And I like what the says, if not the way he says it. But Dr. Nitzkin uses words far better.

Egs:

"The electronic cigarette shows great promise to save lives of those now smoking tobacco cigarettes." True and accurate and well-put, as Nitzkin would write it.

"The electronic cigarette could save hundreds of thousands of lives if smokers switched to using it." Not proven, thus not accurate or true, but exactly the way Siegel writes. Those words are an assumption that too many bloggers express as fact and thus turn off those who want truth and accuracy.

Nitzkin is very careful. Read him. Think about the way he words his thoughts. Siegel has shot from the hip, and while I think he's on target, I find his approach suspect for the masses. But, then, he isn't read by the masses. He's a blogger and doesn't write "articles", but opinion columns.

The FDA is abusing public trust by producing and disseminating reports comparing nicotine delivery of e-cigarettes to smoking cessation devices. They might as well compare e-cigarettes to tomatoes.

The new head of FDA, Margaret A. Hamburg, said at her confirmation hearing that she wants to restore public confidence in the agency by putting science first and by running an open and accountable operation.

This is not the way to do it.
