Just about to read the article and saw this

How do you legalize something that is NOT ILLEGAL. Damn the press.

It is irksome to see that terminology used when they were not illegal. On the other hand I've had a lot of people comment to me (pointing at my APV) saying, "I thought those things were illegal". If that reflects the understanding of the general "non-vaping" population, maybe its a good thing to have a headline that gives the impression that e-cigarettes will not be banned. After all, if that same "general populace" tended to read whole articles, they wouldn't have thought that they were illegal in the first place.

Yes, the very same e-cig prohibitionists who lobbied for, praised and defended Health Canada's purported nicotine e-cig ban are the ones who are now demanding lots of new counterproductive bans, regulations and taxes on all vapor products (including all nicotine free vapor products) to further discourage smokers from switching to vaping.

What I don't understand is why the Canadian Parliament invited, listened to and is now recommending unwarranted e-cig regulatory proposals by the very same e-cig prohibitionists who have been dead wrong about e-cigs ever since they urged and praised Health Canada's ban on nicotine e-cigs in 2008.


Nothing like replacing one failed public policy with another one that is designed by the same idiots.

I wanted the meat from this report in one spot, here are the 14 recommendations from the report,

1) That the Government of Canada financially support research through existing channels, and that these funds be allocated to independent research on the health effects of electronic cigarettes and related devices, and their impact on the uptake of nicotine products by youth and on other tobacco control efforts.

2) That the Government of Canada work with all affected stakeholders to establish a new legislative framework (under the Tobacco Act, new legislation, or other relevant statutes) for regulating electronic cigarettes and related devices.

3) That the Government of Canada consult with the public, provinces/territories and stakeholders with respect to the regulation of electronic cigarettes with a view to protecting the health of Canadians.

4) That the Government of Canada work with all affected stakeholders to establish a new legislative framework (under the Tobacco Act, new legislation, or other relevant statutes) for regulating electronic cigarettes and related devices and that this new framework address both electronic cigarettes that contain nicotine and other substances and electronic cigarettes that do not contain nicotine.

5) That the Government of Canada work with all affected stakeholders to establish a new legislative framework (under the Tobacco Act, new legislation, or other relevant statutes) for regulating electronic cigarettes and related devices and that this new framework require that electronic cigarettes be visually distinct from other tobacco products.

6) That the Government of Canada work with all affected stakeholders to establish a new legislative framework (under the Tobacco Act, new legislation, or other relevant statutes) for regulating electronic cigarettes and related devices and that this new framework establish maximum levels of nicotine contained in electronic cigarette liquid or vapour.

7) That the Government of Canada work with all affected stakeholders to establish a new legislative framework (under the Tobacco Act, new legislation, or other relevant statutes) for regulating electronic cigarettes and related devices and that this new framework establish standards relating to the safety of all components of electronic cigarettes, and also require manufacturers and importers of electronic cigarettes to disclose information relating to ingredients.

8) That the Government of Canada work with all affected stakeholders to establish a new legislative framework (under the Tobacco Act, new legislation, or other relevant statutes) for regulating electronic cigarettes and related devices and that this new framework require that electronic cigarette components be sold in child-resistant packaging, and that all packaging clearly and accurately indicate the concentration of nicotine and contain appropriate safety warnings about the product.

9) That the Government of Canada work with all affected stakeholders to establish a new legislative framework (under the Tobacco Act, new legislation, or other relevant statutes) for regulating electronic cigarettes and related devices and that this new framework prohibit electronic cigarette manufacturers from making unproven health claims.

10) That the Government of Canada work with all affected stakeholders to establish a new legislative framework (under the Tobacco Act, new legislation, or other relevant statutes) for regulating electronic cigarettes and related devices and that this new framework prohibit the sale of electronic cigarettes or other electronic nicotine delivery systems to persons under the age of 18.

11) That the Government of Canada work with all affected stakeholders to establish a new legislative framework (under the Tobacco Act, new legislation, or other relevant statutes) for regulating electronic cigarettes and related devices and that this new framework prohibit the use of electronic cigarettes and other electronic nicotine delivery systems in federally regulated public spaces.

12) That the Government of Canada work with all affected stakeholders to establish a new legislative framework (under the Tobacco Act, new legislation, or other relevant statutes) for regulating electronic cigarettes and related devices and that this new framework restrict advertising and promotional activities for these products.

13) That the Government of Canada work with all affected stakeholders to establish a new legislative framework (under the Tobacco Act, new legislation, or other relevant statutes) for regulating electronic cigarettes and related devices and that this new framework prohibit cross-branding practices, which can involve tobacco industry logos being used on electronic cigarettes.

14) That the Government of Canada work with all affected stakeholders to establish a new legislative framework (under the Tobacco Act, new legislation, or other relevant statutes) for regulating electronic cigarettes and related devices and that this new framework prohibit the use of flavourings in electronic cigarette liquids that are specifically designed to appeal to youth, such as candy flavourings.
