'No E-cigs in the building'

Have any of you ever considered just politely respecting the wishes of the restaurant and not vaping while you're there? Not everything has to be a power struggle.

That's just fine, but the sign doesn't precisely say "No vaping", does it? It prohibits carrying an 'e-cigarette' in your pocket or purse. Are they going to give me a quick pat down before I'm allowed inside? Nope, when they express it like that, I'm gone. Perhaps, I'll let them know why; perhaps not.

If that same option is provided to all establishments to cater to the clientele of their choice.

They can. They can make all sorts of rules about requiring shoes or shirts, wearing a jacket, wearing a tie, etc. They just cant discriminate on the basis of religion, sex, or ethnicity. I think those three things are a FAR cry from not allowing you to vape inside. You might have an argument if they said "no vapers allowed inside."

It's worded poorly and I'm sure they aren't patting people down. Keep it out of plain view and go on about your day/meal.

I too respect the owners of that establishment making that decision. Then it's my choice whether or not I spend my money there. However, that same establishment could NOT put up a sign that says "Caution, smoking is allowed in this establishment. If you don't like tobacco smoke, then enter at your own risk, or choose another establishment." Why not? Because the government has denied the business owner that privilege by passing sweeping, across the board anti-smoking laws. That's what we should fight and be concerned about. I will always respect the owner's right to allow or not allow, but most of the time, the government supersedes the owners rights.

I've been to several restaurants here in the Houston area that still allow smoking and vaping in the outside seating areas and with our weather it's just fine. A few that even still allow smoking in the bar area.

Wild Wings Cafe off I-10 near Katy (outside of Houston) is my bar/grill of choice. Vaping (and smoking) allowed at the bar and at tables in certain areas.

So actually that place could put up the sign that you said they couldn't even with the sweeping regulations because we'll it's true?

If I owned a bar or some family restuarant, I wouldnt allow vaping either. Not everyone is as nice and considerate as the average ECF member and will stealth vape. It just opens the flood gates to everyone. I imagine your eating establishment will start looking kind of like your local BM, hazy clouds hanging in the air, the smell of 100 different flavours wafting about. Not somewhere the average customer probably wants to be in a place where eating is the focal point.

Exactly the point I was making in that reply to Reign that got eaten by the server; I don't like the smell of perfume, even though the vast majority find it either pleasant or have no opinion one way or the other. Just because I think my vapor smells good, doesn't necessarily mean that everyone will agree, and in a restaurant, particularly, aroma is crucial -- maybe someone doesn't want to smell strawberries while they're eating spaghetti! And yes, the haze, even if it's not smoke, might be offensive or unpleasant to anyone. I really see no need to get all het up about it, even if their sign and their syntax is stupid and confusing.

Most places I have been to that do not allow vaping (clinics, etc) do not have signs that state "no vaping", they have signs that either say "no e-cigarettes" or a picture of an e-cig in the red circle, with a line through it.

Please don't take this the wrong way, but with signage like that, wouldn't it really be just common sense to assume it means no vaping, versus you cannot even have an e-cig on your person?

On the question of regulations: Wisconsin passed a "no smoking inside any public building" during the last governor's tenure. And I distinctly remember several bars and restaurants being ......, because they had just spent BIG bucks on new air filtration systems

They did the same thing in Arizona roughly 10 years ago. Many people, including myself, did not agree with it, as we believed it should be the perogative of the business owner on whether or not they would allow smoking in their own business....and the perogative of the non-smokers on whether they would want to patronize that business, or not.

to me that just says "keep out" i wont support stores who dont support things i hold dear like second amendment rights and vaping . while i can understand them not wanting confusion from people who dont know what vaping is they could just make a small "vaping seating area like restaurants used to do with smoking. so looks like rustys looses any of my future business.did they have any outside seating?

I didn't think anybody would actually take my post to this extreme, but in the interest of clarity I'll rephrase the second line of my post:

Which also goes to my point, some restrictions should be the choice of the establishment, not imposed on them.
