Just wanted to share these emails to show how cement-headed some people are. I contacted my local public transit company about vaping on the the bus. Here is my original email and the answer:
Question:
Does Lynx currently have a policy on the use of electronic vaporizers (electronic cigarettes) while riding the bus?
Answer:
The state department of health has not changed it policy to allow the use of use of electronic vaporizers (electronic cigarettes) in non smoking areas. LYNX can not allow this until state make its authorization changes.
Now, I thought it odd that our State's DOH had a policy in place for something as new as a PV, so I proceeded to send this email to the DOH and try to clarify the situation:
Question:
Dear Sirs:
I am curious as to the current regulations regarding retail, non perscrption electronic nicotine vaporizers. Are these devices permissible for use indoors and on mass transit vehicles? Has this
information been disseminated to the various city, county and mass transit authorities?
And the answer:
The Department of Health is responsible for enforcement of the Florida Clean Indoor Air Act which prohibits smoking in enclosed indoor workplaces. Clearly, e-cigarettes does not meet the spirit of the
statute; therefore, the Department does not encourage the use the E-cigarettes indoors and on mass transits.
Now, what I found interesting was this portion of the Florida Clean Indoor Air Act:
386.204 Prohibition.A person may not smoke in an enclosed indoor workplace, except as otherwise provided in s. 386.2045.
386.203 Definitions. As used in this part:
(10) Smoking means inhaling, exhaling, burning, carrying, or possessing any lighted tobacco product, including cigarettes, cigars, pipe tobacco, and any other lighted tobacco product.
Sadly, I did not read it close enough at the time ("do not encourage") to jump on it, so I will be doing this again from another email address.
