All this government control is really starting to get under my skin.

If the government was collecting money off of evey sale of vaping products they would claim it was the best thing since sliced wheat bread.

vaping is a choice be it better than tabacco or not it is a choice we make as adults just like smoking any type of tabacco products is a choice we make.

Knowing! that tabacco is an addictive killer the FDA still allows the sale of it because there is so much money going in thier pockets being tax dollars or under the table dealings.

Our government does not give a .....e about our well being it only uses us as its slaves to produce money for them and thier own families and friends.

Sooner or later if they keep taking away all our freedoms of choice it will come back around and bite them in the ... when WE THE PEOPLE take our freedoms and our country back from these monsters.

Really? REALLY?? This is why I hate anyone in power. They've spent all their time sucking up to gain power and no time trying to get smarter. Is the e-cig 100% safe: as an astrophysicist I have to say that there is no evidence that I've seen to support saying it's as safe as petting a fluffy bunny. Is it safer than a traditional cig: I don't think I have words strong enough to convey how much I agree that it's safer. Will it be marketed to teens: we all remember our teenage years. All we wanted was to grow up or rebel. I know I'm not the only one who saw smoking as accomplishing both. Simply by marketing cigs, alcohol and e-cigs to adults and telling kids "It'll kill you! Don't ever do it!" you're playing to their need to rebel and they will do it anyway. When will these idiots see what they're actually doing? The part about established smokers not willing to switch is the biggest load. I've been a chain smoker since the age of 16 and I'm 28 now. As I physically abuse my keyboard typing this in anger I'm enjoying a delicious pomagranate e-cig of my own mixing. If they ever try to ban e-cigs in Tennessee I'll be the first with a pitchfork and torch.

Re:
A.9529 by Assemblymember Rosenthal
AN ACT to amend the public health law, in relation to prohibit the sale of electronic cigarettes to minors and in relation to prohibiting the sale of any item containing or delivering nicotine that is not defined by law as a tobacco product or approved by the United States Food and Drug Administration for sale as a tobacco use cessation or harm reduction product.

Electronic imitation cigarettes are battery powered personal vaporizing devices made in the united staes as well as imported from other countries. The manufacturers suggest they be used with a propylene glycol solution similar to that in a theatrical fog machine that may or may not contain nicotine. The solutions for use are available in a multitude of flavors that emulate tobacco, fruit and myriad other flavors traditionally associated with eating or drinking. There are no identified experts in this field as of yet but the online communities surrounding these devices are comprised of thousands of adults that are using them as an alternative to the proven killers that are tobacco cigarettes.

All of the scientific evidence so far has delivered a preponderance of evidence that indicates electronc imitation cigarettes are vastly safer than regular tobacco products. In fact, the U.S. Food and Drug Administration (FDA) conducted one initial and limited study into the products in July of 2009, which confirmed that there are only trace elements of a very small percentage of the harmful elements of a traditional tobacco cigarette. FDA scientists found that the products contain between zero to 4 carcinogens as compared to over 44 found in traditional tobacco cigarettes. The FDA also found that only one of 12 samples tested contained any traces of the same element of antifreeze that is found in traditional tobacco cigarettes.

Unlike the "light" and "low tar" cigarettes that tobacco companies claimed were healthier for consumers, there actually is an abundance of evidence to back up the claims made by electronic imitation cigarette makers. In September of 2008, the World Health Organization stated they have "no evidence to confirm the product's safety or efficacy." since 2008 a number of studies have been made public and they should not be ignored. The U.S. Public Health Service cessation guidelines recommend proven ineffective methods with a minimal efficacy suggesting that is not a primary concern of the recommendation.

The initial FDA determination that these products should be regulated as drug-delivery devices and such, should not be sold until the FDA has determined their safety and efficacy was determined to be beyond the FDA's scope of authority by a federal judge. The FDA is currently appealing that decision but should not be given that authority on the state level while the determination is still pending on the federal level. That would be a circumvention of our entire judicial system in America to afford the FDA that regulatory authority on a state level.

I sent the following. I hope that it will be read and taken in the spirit it was intended.

I am a 58 year old adult, who, with the use of the electronic cigarette, is tobacco cigarette free for the first time in 40 years. I have not quit smoking, in the true sense, considering, like the tobacco cigarette, the electronic cigarette cartridges I choose still contains nicotine, a tobacco bi-product. I have given up, however, the actual tobacco and the nasty residue created from combustion. I have eliminated the tar, the carbon monoxide, the glue and a host of other carcinogens that are known killers. I no longer pollute the air with first or second hand smoke, I not longer carry or emit any offensive odors, and I no longer deal with ashes, dirty ashtrays or cigarette butts. I can breathe better, I have more energy, my sense of smell is returning and I'm saving money. I honestly hope you don't mind if I do not return to smoking tobacco cigarettes and that you will support that decision by voting no to bill S7234 before you. Please do not allow this bill to pass and force of age, tax paying, law abiding citizens to make a choice between a legal tobacco product that is environmentally offensive and known and proven to be detrimental to life and an illegal one, that by a preponderance of evidence, is more environmentally friendly, cleaner, less toxic, less expensive, and less offensive.

I remain,

Donna Tremblay

Love this letter... and all of them that I've read!

I am not a NY resident, so I am not sure, but here in VA, we have a news team that does a segment "On Your Side". Do you guys have anything like that up there? (I lived in CT and know a couple of their news stations did segments like that) Has anyone tried going to the news with the positives? Or would it likely bring negative attention? Just curious!

Fortunately, VA seems to be slow passing laws. We can still use cell phones while driving, a law that was passed five or so years ago in CT. VA still allowed smoking in public places until just recently, which I thought, even as a smoker, was absurd. So I am hoping that VA is just as slow on this type of law.

@Yolanda
"In sum, given the ever mounting evidence that electronic cigarettes are in fact a much healthier alternative to smoking conventional cigarettes for those who choose to switch to them instead (see links below), it would be a devastating blow to public health in New York State for lawmakers to blindly follow the disingenuous and misleading statements of those working to effect their outright ban, primarily lobbyists for so-called health groups who are merely fronting for their funders in the pharmaceutical industry"

Fantastic Letter! Great Summation! Could never be stated Better!

I really don't understand why 'Tobacco products' and ecig products can even be used in the same sentence!

It's like alcohol makers having to label their products as gasoline, it's pathetic.

Also I loved the way that lady convinced the rest of the board (who have never probably even heard of an e-cig) that it's pretty much the same as consuming anit-freeze

No, more like ethanol is a wheat or sugar product. It's what it originates from. Nicotine used in ecigs originates from tobacco.

Unfortunately, nicotine can only be regulated in the U.S. under just two catagories - tobacco product or drug.

If we let them catagorize it as a drug, it will be reomved from the market until it can be tested and proven as "safe," exceedingly high standards must be met, taste and nicotine strength will be reduced, prices will be jacked up to pay for the testing and then they can be sold only by approved drug companies.

As a tobacco product, such testing is not required, standards are lower and they can remain on the market. Taxes will be added, but even if they are taxed as high as cigarettes, they will still be 1/2 the cost of cigarettes and only 1/4 the cost if it were called a drug.
