This bill would:
If enacted, prohibit all sales of electronic cigarettes. It amends New York Public Health Law, §1399-11, enacted in August 2000, which prohibited cigarette sellers and common carriers from shipping cigarettes directly to consumers.


The bill was introduced in the Health Committee and may be referred to the Rules Committee which meets daily. Thus it could be sent to the full Senate at any time. So it is urgent that messages be sent to members of the Rules Committeeimmediately.



NOTE: You do not need to include all of the items listed below, but the first two are vital.


What to say:
1. Let them know that you strongly oppose S07635 that would ban all electronic cigarette sales, but that you do support a ban on sales to minors. Senator Johnson's S02926B (same as A 9044-B introduced by Assemblymember Linda Rosenthal) would appropriately ban sales to minors while keeping the products available to adults as a reduced-risk alternative to smoking.


2. Tell your story on how switching from smoking cigarettes to a far less hazardous alternative product has changed your life. When and why did you start using an e-cigarette? What effect has this had on your smoking of tobacco cigarettes? What has been the effect on your health?


3. Explain that research has consistently shown that virtually all e-cigarette users are using them as a substitute for smoking. The vast majority tried to quit smoking multiple times, using the other methods available and failed.


4. Tell them that there are an estimated 250,000 e-cigarette users in New York. Many, deprived of the ability to purchase e-cigarettes in New York, will return to the far more hazardous act of smoking since tobacco cigarettes will, ironically, continue to be readily available in New York.


5. Tell them that e-cigarettes have been shown to pose so little health risk that it is below what can be measured and no one has even tried to estimate it.
a. Claims about chemical contamination are vastly overblown. Some of the supposed contaminants occur as such incredibly low levels that they are barely measurable using the most modern instruments.
b. Pharmaceutical nicotine products like patches and nicotine gum contain about the same quantities of “carcinogens” as a gram of e-cigarette liquid—about 8 nanograms. In contrast, a pack of Marlboro cigarettes contains 126,000 nanograms.
6. Tell them that cigarette lighters and home fires started by smoking tobacco cigarettes cause far more injuries than e-cigarettes have. According to one study, well over a thousand people are injured per year due to defective lighters [news story], and over 1,000 people are killed by fires caused by smoking [FEMA].

7. As for smoking itself, on average, it is estimated that smoking for just a couple of months poses a greater health risk than a lifetime of using a smoke-free nicotine or tobacco product.

Well folks, this is probably the most damaging piece of legislation we have had to face so far.
The only other one that even comes close was the proposed 70% tax on electronic cigarettes in Hawaii recently.

We as a community were able to help defeat that legislation.
Floods of calls and letters came in from all over the country, and the legislators duly noted that the response was passionate and overwhelming.

And I damn well know for sure that we as a community better do something about this one, and fast.
Because if this atrocity passes, we are all next in line!

Federal government, states and cities pass bans or taxes on tobacco products. If you are a taxpayer in NY, please respond. If you don't live in NY, it doesn't matter.
I think you forgot to add "Until they use NY as an example for your state". This should matter to EVERYONE here. This should matter to nonsmokers who would prefer there be less butts on the ground, less smoke in the air, less people unhealthy and causing strain on our already messed up health care system. This should matter to smokers who have no intention now of quitting because they want to have the option even if they don't choose it. It sure as hell should matter to all of you, because if enough states fall to this, it goes national. It should matter to you because we KNOW the information used in the justification of this bill is half truths and blatant lies. If they can do this to e-cigarettes, then they can do this with anything they want to.

As someone not living in New York, I can assure you what you say is true.
But you probably already know that.

In fact, we already know this is how "they" operate from the many battles we have fought with "them" through the years.

They get their foot in the door, and then use that to convince everyone else that everyone else is doing it.
They have no hesitation to do whatever it takes to get what they want.

And what they want is money, and they don't give the slightest damn about your lungs or your cancer.
And they give even less of a damn about the lungs and cancers of those smokers who have not yet found a way to save themselves.

This is about so much more than our health, and about so much more than our rights and liberties.
It is about the health, rights, and liberties of every American.

And honestly, if you get right to the heart of the matter, it is about every human being on earth.

This is a place we can still fight, make a difference, and even win.

In fact, winning on these issues is something that we as vapers have been doing quite a lot of thanks to our passion and dedication.
And of course, the fact that we have truth on our side doesn't hurt any, even though truth is usually an afterthought.

Election year grandstanding and sucking up to special interests.
They know full well that they can't ban e-cigs from being sold to adults.
All they can do is the same thing they can do with cigarettes. Tax them to death and stop them from being sent via mail.
If anyone could impose a ban, the FDA would have done it already and they're reduced to fantasizing about what they could do if they were sold as "therapeutic devices, which they aren't.
Like the pol mentioned in the AP article. They're spurring discussion.
This is just like the hundreds of proposals that spring up every year to outlaw abortion, or criminalize being gay or some other stupid idea that could never hold up in any court.
Freaking idgits do this all the time, proposing legislation that has no chance of passing, let alone withstanding a legal challenge.

But write them anyway. Let them know we're keeping an eye on them in case they ever actually try to pass a law that would actually stand up to the simplest of legal challenges and wasn't just toothless barking.
