The proposed ordinance is at
The New York City Council - File #: Int 0488-2014

But careful anylsis of the proposed ordinance reveals that it would ban the sale of flavored cigalikes, not flavored e-liquid that is sold separately.

None of the definitions for "component", "electronic cigarette" or "flavored electronic cigarette" apply to e-liquid that is sold in separate bottles/packages.

Although the first part of the definition of "constituent" applies to flavorings in e-cigs, the last part of the definition "during the processing, manufacture or packing of the tobacco product or electronic cigarette" specifically exempts e-liquid that is sold in separately.

This reminds me of the NY state laws that bans sales of e-cigarettes to minors, but that doesn't apply to e-liquid (because the bill's author Linda Rosenthal was clueless about e-cigs). Last year, Rosenthal realized her incompetence and offered a bill to amend to the law to also ban the sale of e-liquid to minors.

Does it mean they are banning only BT products????

I love New York!

What's more, how many flavored cigalikes are even sold at retail outlets? The brands that are most widely available at convenience stores and gas stations don't even come in flavors (except for Blu, I guess), so I wonder what Councilman Constantinides thinks this ordinance is actually going to do.

ETA: Wrong link.

""Flavored electronic cigarette" means any electronic cigarette or any component part thereof that
contains a constituent that imparts a characterizing flavor."

Looks like menthol is out. Finally the racist anti-smoking zealots got rid of menthol.

;)

Well, tobacco is an added flavor too, if you want to be technical about it. The only non-flavored components of an e-cigarette cartridge are PG, VG and nicotine.

Well that's ok though:

"d. "Constituent" means any ingredient, substance, chemical or compound, other than tobacco, water or
reconstituted tobacco sheet
, that is added by the manufacturer to a tobacco product or electronic cigarette
during the processing, manufacture or packing of the tobacco product or electronic cigarette. Such term shall
include a smoke constituent."

But PG, VG isn't, according their definitions, unless "reconstituted tobacco sheet" includes them

All I ever hear about is how easy it is for kids to pick up one of these e-cigarettes. I mean, the 70 half smoked cigarette butts on the ground you can find by walking 1 block in almost any city is definitely not an issue, cause kids won't pick those up. Haha, I mean, the 100 needles in the ally way of most cities isn't making it any easier for kids to pick those things up, no way. That fact that I, a 20 year old, have two gallon bottles of vodka sitting right beside me, means it's way to hard for any kid to get their hands on alcohol. These e-cigarettes aren't laying in front of almost every building in the world in an ash tray. Nor are their guys standing on corners giving samples out to 12 year olds so they'll come on back.

In all reality, people need to stop using kids as an example. I would MUCH rather (if I had no choice) catch my daughter using one of my nic free vaporizers than catch her outside smoking like I did my sister when she was 14.

Just sayin.

LOL. Quality VG (in a NIC + PG base) has a subtle sweet FLAVOR/taste. Low/poor quality "NIC" in a base of PG and or VG only has a pepper like FLAVOR/taste. We test for this stuff in the DIY world.

Sorry...

You're right.

No prob and I didn't mean to call you out.

Vuse/Reynolds is trying to give the e-cig industry a black eye and is pushing to get all open tanks and e-liquid banned.

V2 supports the rights of vapers and product innovation.

The important thing here in this thread though is calling attention to scary legislation like this in NYC. Big Tobacco may want to see legislation like this passed country wide in hopes it would drive more people back to their tobacco products.

I know--they even lobbied against flavored e-liquids.

I know. i checked their website--they are now in a partnership with National Tobacco Company. What do we know about them? Just curious.

USA. State: Inebriated.
Lol.. Anyone read this?

And anyone notice.. That their definitions of e-cigarette/"flavored e-cigarette" are kind of.. Wrong?

And what the hell does this part mean:

Some jerk government lawyer-talk said:
It shall be unlawful for any person to sell or offer for sale, or to possess with intent to sell or offer for sale, any flavored tobacco product or flavored electronic cigarette except in a tobacco bar.

Anyone find this wording DANGEROUSLY close to Controlled Substance laws?

I-a. It shall be unlawful for any person to manufacture, sell, purchase, transport or possess with intent to sell, dispense, compound, package or repackage (1) any substance which he represents to be a controlled drug or controlled drug analog, or (2) any preparation containing a substance which he represents to be a controlled drug or controlled drug analog, except as authorized in this chapter.

I live in New York State, but far away from NYC. Never been there. We have in this state a wealth of highly intelligent people, unfortunately few of them are politicians. We have a lot of very smart and very savvy political operatives, but very few really intelligent people who are in power. The same can be said for a number of states in the US. I won't go there.
This is not about the children, or about public health, or even about the money. This is about power: who has it now, and how can it be wrested from them and magically conferred upon me. Our US senator chuck schumer is one of the best that's ever played this game. Take away 3 of your constitutional rights today, give you back 2 of them tomorrow and have you believe he's a hero of constitutional rights. He's been in office for how many years?
If these people want to take vaping away from you they will do it. Get out and vote. Let the politicians know how you feel about the issue. Inform friends, colleagues and co-workers. Then get out and vote.

This really burns my .... DECADES of painful litigation and we FINALLY gain ground on having cigarettes looked negatively upon and their sales broken down... 5 short years and vaping is the scourge of the planet...

Im not saying big tobacco is putting its money into shutting down vaping.... but... well... Doesn't take a rocket surgeon to see which way the wind is blowing.
