@Stormfinch, well that's the nub realy. Regulating ecigs as drugs or tobacco is a bad fit for so many reasons but who has the enthusiasasm for another set of standards, rules and all the administration to enforce these regs. Gov wants a quick and easy fix, Pharma want the drug all to themselves and tobacco want ecigs advantages restricted so as not to affect their core product before they are sure of the market.

In the EU the tobacco products directive has described ecigs under a new category Nicotine Containing Products (Oddly not including NRT) Unfortuniatly they are just subjecting NCP to the existing and future regs for tobacco. A missed oportunity I fear.

This has echoed my longstanding thoughts that while the FDA and other agencies would love to lace into our world of vaping, the laws as they exist now just simply do not allow them to do so, and any semi-legal attempts will likely be struck down in courts. Even Supreme Court justices have to follow the legal precedents, after all.

I belive, contrary to the commonly seen sit in a corner and piss yourself with worry mentality, that the e-cig industry has far more allies and options available and a far greater chance to win this war than anyone would have predicted a year ago. I think deeming reg is dead. I think banning is dead. I think flavor restrictions are dead. I think banning online sales was never a reality (cause I can buy a gun online...). I think this is the one answer no one in the agencies ever wanted to see; one that can defeat the tobacco monsters, kill the bloody dollar bills from tobacco tax, not have huge risks, and not fall within regulatable guidelines. I think this may be an end-game of sorts...for the FDA. It is my belief that they may be looked at as corrupt, ineffective, fearful, and too concerned with protecting special interests to do the American people any real good.

I've said it before, I will say it again, loudly. Get up! Stop the cycles of worrying and start fighting! Fight hard, fight dirty, fight like your lives depend on it, because their is a big chance that they do. Do not accept being required to take poison to satisfy an addiction! DO-NOT-ACCEPT-BEING-GOVERNED-BY-THE-HIGHEST-....ING-BIDDER! Everyone that can spare even a minute of their time, join the fight, be on the right side of this problem. Let's do this!

I don’t think our fight against FDA deeming is over, but if this turns out to be true, we need to turn our attention to fighting state and city bans and regulations. The ANTZ will inevitably increase their efforts there if they don’t win at the federal level. These fights could be harder, because a vaper in say Virginia isn’t as concerned with what is happening in New York or California.

Let's not make the same mistake that Germany made in WWII, and keep a united front. A vaper is a brother in arms, no matter where. We need to be pushing against a ban the same way the NRA does; as an affront to our civil rights, and once it starts, where will it end?

I'm probably going to regret asking this, but did you seriously just compare potential federal, state, and local legislation on e-cigs to the fate of Nazi Germany in World War II?

I sincerely hope I misread your post. :blink:
